On the oral prayer made by Mr. BP Sinha, learned counsel for the petitioner, the Deputy Commissioner, Nagaon, who is the Chairman of the District Level Committe e, is allowed to be impleaded as respondent No.4 by hand. Heard Mr. BP Sinha, learned counsel for the petitioner, Mr. AD Choudhury, learne d standing counsel, Education Department appearing for the respondent Nos.1, 2 a nd 3 and Mr. G Sarma, learned State counsel appearing for the respondent No.4. As agreed to by the learned counsel appearing for the parties, the writ petition is taken up for disposal at the motion stage itself. The grievance of the petitioner in the present petition is that though after the death of her husband in harness on 21st July, 2008, she filed an application fo r appointment on compassionate ground in the month of March, 2009, the said appl ication has not been placed before the District Level Committee so far. Mr. Sinha, learned counsel for the petitioner, therefore, submits that the prese nt petition may be disposed of directing placement of the petitioner’s case for consideration before the District Level Committee. Mr. Choudhury, learned standing counsel, Education Department as well as Mr. Sar ma, learned State counsel appearing for the respondent Nos.1 to 4 submit that if the petitioner’s case has not already been disposed of by the District Level Co mmittee, the same shall be placed before the District Level Committee and necess ary recommendation shall be made in that regard. Having regard to the aforesaid submissions advanced by the learned counsel appea ring for the parties, the writ petition is disposed of directing placement of th e petitioner’s case before the District Level Committee in its next meeting, if not already placed and no decision, in the meantime, has been taken. In case, t he District Level Committee has recommended the case of the petitioner, the same shall be placed before the State Level Committee for consideration. The petitio ner, within 10(ten) days from today, shall produce a copy of the writ petition a nd annexures appended thereto alongwith a copy of the order passed today before the Deputy Commissioner, Nagaon. The writ petition is accordingly disposed of. No costs.
