HON’BLE MR. JUSTICE P K MUSAHARY Heard Mr. B Bora, learned counsel for the accused petitioner. Also heard Mr. B.S .Sinha, learned Addl. Public Prosecutor, Assam who has produced the case diary i n connection with Jalukbari P.S.Case No.570/2012 under Section 447/ 420/ 323 IPC . On perusal of the case diary it appears to me that the victim gi rl voluntarily came to the Railway Quarter where the petitioner has been living with his family members but she was forcefully driven out by the local women o rganization. The case was registered under sections 447/420/300 IPC. In my considered view the ingredients of offence under the afore said sections of law are absent. In view of the above the interim bail order dated 22.8.2012 is m ade absolute on the same terms and conditions. However, accused petitioner shall appear before the I.O.concerned within a period of 7(seven) days from today for recording his statement in accordance with law. The petition stands disposed of.
