The petitioner is an accused in connection with the Dhubri PS Case No. 67/09 U/S 389(B)/489( C) IPC. It is submitted by the learned counsel for the petitioner that the petitioner was issued summon on 11.11.10 in connection with the Dhubri P.S. Case No. 67/09 U/S 489(B)/489(C) IPC ( GR No. (DBB) 67/09) by the learned CJM, Dhubri to appear before the court on 21.12.10 but the petitioner did not a ppear before the court and approached this court praying for bail. Since the su mmon has been issued the petitioner ought to have been appeared before the court . It is submitted by the learned counsel for the petitioner that the petitioner is of the apprehension that he has been shown as absconder in the charge sheet a nd the learned CJM may take adverse impression against the conduct of the petiti oner. It is open for the petitioner to satisfy the learned CJM that the petitioner was not an absconder and shall appear before the court as and when required in the next date fixed. With this observation, this pre-arrest bail application stands disposed of.
