AB 1622/2011 BEFORE THE HON’BLE MR. JUSTICE K. MERUNO Heard Mr. N. Alam, learned counsel for the petitioners and Mr. K. Munir, learned Public Prosecutor for the State. At the very outset the learned P.P. submits that the case has already been submi tted on 29.5.2011 vide Charge Sheet No. 45/2011 and the matter is pending trial before the court of the Chief Judicial Magistrate, Barpeta. Considering this vie w of the matter and also that the petitioners in this application are all above 60 years except the petitioner nos. 4 and 5, who are sons of the petitioner nos. 1 as well as that the case has already been chargesheeted, the petitioners ma y approach the court below where the case is pending trial and apply for regula r bail. However, till the petitioners approach the court below for obtaining necessary r egular bail, the interim order passed by this Court on 10.6.2011 shall continue. It is also ordered that the interim order in which the petitioner nos. 5 and 6 were left out, shall also be covered by this order. Accordingly, this bail appli cation stands disposed.
