Judgment
Heard Mr. S.Munir, learned Counsel for the petitioner and Mr. B.S.Sinha, learned Addl.P.P,Assam. The petitioner Musstt. Diluwara is apprehending arrest in connection with Kachu a P.S. Case No.87 of 2010 registered under Section 302/34 IPC. The learned Addl .P.P,has produced the Case Diary and on perusal of the Case Dia ry it reveals that the petitioner is innocent and she is no way involved in the alleged offence and as such she is entitled to be granted the privilege of pre- arrest bail as provided under Section 438 Cr.P.C. Accordingly, it is provided that Mustt. Diluwara Begum, in the event of her arre st, she shall be released on bail on furnishing a Bail Bond of Rs. 10,000/- with one surety of the like amount to the satisfaction of the arresting authori ty on conditions that she shall make herself available to the I.O as and when re quired; that she shall co-operate with the investigation and that she shall not leave the jurisdiction of the Court of the learned C.J.M,Nagoan without obtainin g prior permission of that Court. With the above directions this bail petition stands disposed of.
