Mr Nigam, Iearned Senior Counsel appearing for the Appellant also contends that both orally as well as in writing, it had been contended by the Appellant that BIS Rules have been transgressed by. the Respondents. But th-e impugned Order does not deal with these arguments.. In these circumstances, Counsel for the Appellant seeks leave to withdraw the Appeals so as to approach the learned Single Judge.with a prayer to pronounce Orders on the FAO(OS)54/2O1.1 Signature Not Verified Digitally Signed By:AMULYA Certify that the digital file and physical file have been compared and the digital data is as per the physical file and no page is missing. Page L of 2 a Appellant's application under Order XXXX Rules L and 2 as well as to make pronouncements on all the arguments raised by them before the learned Sing1e Judge. Leave to withdraw the Appeals is granted. The withdrawal of the Appeals shall not prejudice the Appellants from approaching the Cour[ after the Review is decided. The right to challenge the Order impugned before us shall not be foreclosed by the withdrawal of these Appeals. Mr Nigam also emphasizes on the fact that no reflection be made on the genuineness of the Invoices filed by the Respondent before the learned Single Judge.
