Operative part
application has been disposed of vide order dated 24^^ January, 2011, whereby it has been directed that in case FIR is registered, seven days prior notice be given to petitioners before their arrest. Petitioners were also directed to deposit their passports with the CAW Cell. It is this direction regarding deposit of passport petitioner No.3 and 4 which is being assailed in this petition. It is submitted that petitioner No. 3 is working as Director, Star Tree Technology (P) Ltd.; whereas petitioner No. 4 is working as Vice- President (Information Technology) with International Corporation Signature Not Verified Signing Date:17.08.2024 17:00:37 Certify that the digital and physical file have been compared and the digital data is as per the physical file and no page is missing. Solutions India (P) Ltd. In connection with their employment have to visit foreign countries. Petitioner Nos. 3 and 4 were not living with the complainant. They are living in Vaishali, Ghaziabad, Uttar Pradesh. In the facts and circumstances as narrated above, I am of the view that Trial Court was not right in directing petitioner Nos. 3 and 4 to deposit their passports with the CAW Cell. Condition of deposit of passport as contained in the order dated 24^^ January, 2011 of the Additional Sessions Judge, Delhi against the petitioner Nos.3 and 4 is set aside. Their passports be returned to them. Petition is disposed of in the above terms. APRIL 07, 2011 c$>-—'t— i.K. PATHAK, J.
