The petitioner has filed the instant petition seeking following reliefs:- 2 “10.1 That this Hon'ble court may kindly be pleased to call the entire record of the Courts below.

10.2 That this Hon'ble court may kindly be pleased to issue a writ of MANDAMUS directing the respondent No. 03 to take action upon the application for division made by the petitioner in accordance with law and to decide the same within stipulated time frame as directed by this Hon'ble Court.

10.3 That this Hon'ble court may kindly be pleased to direct the respondent No. 02 to take action against respondent No. 03 as per provision of Chhattisgarh Lok Sewa Guarantee Act, 2011.

10.4 That this Hon'ble court may kindly be pleased to issue any writ or direction or order as deem fit in the interest of justice.

Learned counsel appearing for the petitioner submits that the application is not being decided by the concerned Tahsildar in respect of partition.

Learned counsel for the State has made an objection that the application itself is not filed in the appropriate format and that the petitioner has to file an appropriate application before the concerned Tahsildar in respect of partition, while properly making 3 the required parties, who are required to be noticed, which has not been done in this case.

At this stage, learned counsel for the petitioner seeks permission of this Court to withdraw this petition and to file an appropriate application before the concerned Tahsildar in the proper format in respect of partition, as prayed by him.
