The petitioner seeks regular bail in connection with Sadar (Muffasil) P.S. Case No. 31 of 2023 for the offence registered under Section 7 of the Essential Commodities Act, 1955 and 7/7 (i) (a) (ii) of the Fertilizer Control Act, 1985.
Allegation against the petitioner is that he is using Urea fertilizers illegally and 100 bags of Urea were illegally stored in the premises of M/s Laxmi Plywood Industries.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. He has no concern with the seized fertilizer. He is neither owner of the tractor nor any concern with the said Patna High Court CR. MISC. No.82217 of 2023(2) dt.09-01-2024 fertilizer. Petitioner is languishing in jail custody since
25.09.2023 having no criminal antecedent.
Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.
Considering the submissions on behalf of the parties and the facts and circumstances of the case, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned concerned court below in Sadar (Muffasil) P.S. Case No. 31 of
