JUSTICE GOPAL PRASAD ORAL ORDER 3 31-05-2012 Heard learned counsel for the petitioner and learned counsel for the State. The petitioner is apprehending his arrest in connection with Laukaria P.S. Case No. 44 of 2011, registered under Section 7 of the E.C. Act. It is alleged that some articles were found from the shop of the petitioner. Learned counsel for the petitioner submits that petitioner has got licence for selling fertilizers which has been annexed as Annexure-2 of this petition and hence there is neither any violation of Section 7 of Fertilizer Control Act, 1985 nor Section 7 of the E.C. Act. Having regard to the facts and circumstances of the case, above named petitioner in the event of his arrest/surrender Patna High Court Cr.Misc. No.13663 of 2012 (3) dt.31-05-2012 within a period of four weeks from today, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bagaha, West Champaran, in connection with Laukariya P.S. Case No. 44 of 2011, subject to condition as laid down under Section 438 (2) of Cr.P.C, with a further condition that petitioner shall cooperate with the police during investigation. m.p.
