JUSTICE GOPAL PRASAD ORAL ORDER 3 17-04-2013 Heard learned counsel for the petitioner and learned counsel for the State. This is a petition for grant of regular bail in a case under Sections 341, 323, 504, 324 and 307/34 of the Indian Penal Code. There is allegation against the petitioner that he gave a dagger blow to the son of the informant as a result of which he sustained injury. However, the opinion about the injury on the person of the injured has been kept reserved. Learned counsel for the petitioner submits that the charge-sheet has been submitted against the petitioner. The petitioner is in jail custody since 10.09.2012 and he has no criminal antecedent. Hence, having regard to the facts and circumstances of the case, the petitioner above named is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) Patna High Court Cr.Misc. No.49175 of 2012 (3) dt.17-04-2013 with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Jay Nagar P. S. Case No. 198 of 2012, subject to the condition that one of the bailors shall be the near relative of the petitioner who will file affidavit to the effect that the petitioner has no criminal antecedent which fact should be verified by the court below and thereafter the petitioner be released of bail.
