Heard Mr. Bimlesh Kumar Pandey, learned counsel for the petitioner and learned APP for the State.

Taking into account the facts/submissions put forward by the parties, the coordinate Bench while granting provisional bail to the petitioner sought a report from the Superintendent of Police, East Champaran, Motihari as to why despite coming into force of the Bharatiya Nagrik Suraksha Sanhita, 2023, the Cr.P.C. were incorporated.

It is unfortuante that the Superintendent of Police, East Champaran, Motihari has not bothered submit Patna High Court CR. MISC. No.70335 of 2024(3) dt.30-10-2024 any report as per the office report.

Waiting for an infinite period awaiting report of the Superintendent of Police, East Champaran, Motihari cannot be done. The petitioner has been granted provisional bail as recorded, the same is now confirmed.

The provisional bail granted on 07.10.2024 to the petitioner by a coordinate Bench stands confirmed.

Accordingly, the bail application stands disposed of.

The Superintendent of Police, East Champaran, Motihari is cautioned to desist from violating the order of the High Court.
