JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 2 19-04-2012 Heard learned counsel for the parties. The grievance of the petitioner is that there is illegal encroachment on a public road bearing plot no. 2159 passing through village Kamraown, Anchal-Dalsingsarai, District- Samastipur, which plot has been described as Gair Mazarua Aam Rasta in the Khatiyan. It has been alleged on behalf of the petitioner that the said public road has been encroached by private persons including respondent no. 5. He seeks a direction from this Court to get the land in question measured and encroachment removed, if any. He has further submitted that in spite of his request / representations in this regard to the Circle Officer, Dalsingsarai, 2 Patna High Court CWJC No.7701 of 2012 (2) dt.19-04-2012 Samastipur, no step has been taken in this regard. Keeping in view the nature of allegation, learned counsel for the State assures that if the petitioner approaches the Sub-divisional Officer, Dalsingsarai, in this regard, the same will be looked into and the final orders will be passed in accordance with law. In such circumstances, it is directed that petitioner shall approach the Sub-divisional Officer, Dalsingsarai, Samastipur, raising the grievance which he has raised in the present writ application within four weeks from today. The Sub-divisional Officer, Dalsingsarai, Samastipur, shall pass necessary orders within eight weeks thereafter. It is made clear that I have not gone into the merits of the allegation made in the writ application. With this observation / direction, the writ application is disposed of.
