JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 2 27-02-2013 Heard learned counsel for the petitioner as well as learned APP for the State. Informant, Pannalal Yadav had alleged that while he along with Deepak Kumar Choudhary were in the way to their house, they were intercepted by Sikandar Ram, Ajit Kumar and one unknown person out of whom, Sikandar Ram on the point of fire-arm snatched away his packet containing Rs.35,000/-, a mobile set and a wrist watch while Ajit Kumar had snatched away Rs. 5,000/-, torch, a mobile of Deepak Kumar Choudhary and then thereafter all the three escaped. It has been submitted on behalf of the petitioner that neither any incriminating article has been recovered from possession of the petitioner nor has he been put on TIP and only on the basis of inculpatory extra judicial confessional statement, charge-sheet has been submitted against him including others. Patna High Court Cr.Misc. No.8066 of 2013 (2) dt.27-02-2013 Also submitted that petitioner is in custody since 05.03.2012. On the other hand, learned APP opposed the prayer for bail and submitted that in a dare devil manner the instant crime has been committed. In the aforesaid facts and circumstances of the case, petitioner, Sijay Ram is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri A.K. Roy, Judicial Magistrate 1st Class, Supaul/successor in the office in connection with Kishanpur P.S. Case No. 30/2012. perwez (Aditya Kumar Trivedi, J)
