JUSTICE JYOTI SARAN ORAL ORDER 3 30-09-2013 Heard Mr. Ajay Kumar Thakur learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Bachwara P.S. Case No. 108 of 2009 ( Sessions Trial No. 120 of 2013) for the offences punishable under Sections 341, 324, 326, 307, 302/34 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the only allegation against this petitioner is of physically assaulting the deceased with a pistol while there is a specific allegation against co-accused Niranjan Kumar of opening fire from his carbine upon the deceased Sandeep Chaudhary and consequent whereupon he died during the course of the treatment. It is submitted that the altercation is in relation to allotment of wine shop and there is a case and counter case. It is stated that 2 Patna High Court Cr.Misc. No.24319 of 2013 (3) dt.30-09-2013 although the petitioner has surrendered after some delay but has remained in custody since 4.1.2013. Regard being had to the circumstances, let the petitioner namely, Pankaj Singh @ Bageri be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Additional Sessions Judge F.T.C.-V, Begusarai in connection with Bachwara P.S. Case No. 108 of 2009 ( Sessions Trial No. 120 of 2013). Bibhash/- (Jyoti Saran, J)
