2 18-04-2013 Heard learned counsel for the petitioner and learned counsel for the State. The petitioner is one of the named accused of a case which has been registered for offences under Sections 341,323,325 and 307/34 of the Indian Penal Code. The fardbeyan of Pankaj Kumar narrated that when he was returning to his house from Chandi Market, in the way the petitioner and other accused persons intercepted and assaulted him. When his friend Ratan Kumar came for rescue, he was also assaulted and that assault has resulted into grievous injury. Submission is that as there was no intervening circumstances, so no case under Section 307 of the Indian Penal Case is made out. There is also no specific as to whose assault caused injury to the informant or his friend. Further submission is that the petitioner has fair antecedent. Patna High Court Cr.Misc. No.16866 of 2013 (2) dt.18-04-2013 Considering the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in Chandi P.S.Case No. 209 of 2012.
