2 12-07-2013 Heard learned counsel for the petitioners and learned counsel for the State. The petitioners seek bail in a case which has been registered for offences under Sections 406, 408, 420, 120B, 467, 468 and 471 of the Indian Penal Code and under Section 76 of Chit Fund Act read with Section 7(2) of Bihar Depositors Protection Act, 2002 read with Rule 2004. It was reported by the Block Agriculture Officer to the Police that the Co-operative society’s members and its staffs are committing various irregularities. The Police went there and when no paper was produced, the petitioners were arrested. Submission is that the petitioners are employees of Patna High Court Cr.Misc. No.28628 of 2013 (2) dt.12-07-2013 Co-operative Company namely, Jyoti Credit and Saving Swablambi Sahkari Samitti and the case was lodged due to misunderstanding. Sahkari Samitti is a Multi State Co-operative Society which has been established after obtaining certificate of registration from Ministry of Agriculture, Department of Agriculture and Cooperation, Government of India, New Delhi. Further submission is that the petitioners are not at all concerned with any misappropriation or fraud rather they are merely staff of the Sahkari Samiti and they are discharging their duties as per their superior. Considering the facts and circumstances of the case, let the above named three petitioners be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani in Khajauli P.S.Case No. 35 of 2013.
