CORAM: HONOURABLE MR. JUSTICE AMARESH KUMAR LAL ORAL ORDER 2 18-04-2012 Heard the learned counsel for the petitioner and Mr. A.Khan, learned A.P.P. for the State. The petitioner is an accused in Ramgarh P.S. Case No.138 of 2011 for the offence punishable under Sections 302/120B of the I.P.C. It is submitted that the petitioner has been falsely implicated in this case due to previous enmity. There is no specific allegation against the petitioner. It is further submitted that neither the petitioner was arrested on the spot nor any incriminating articles were recovered from his possession. He has no criminal antecedent. It further submitted in similar facts and circumstances, the co-accused namely, Ravi Kant Ram and Umesh Ram have been granted bail vide order dated 26.03.2012 passed in Cr. Misc. No.8162 of 2012 and Cr. Misc. No.8622 of 2012 by a Bench of this Court. Learned counsel for the State could not controvert the Patna High Court Cr.Misc. No.16128 of 2012 (2) dt.18-04-2012 2 contention of the learned counsel for the petitioner while opposing his prayer for bail. Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua in P.S. Case No.138 of 2011 with the following conditions :
One of the bailors will be the close relative of the petitioner. The petitioner will not indulge in similar or in any other offence. The petitioner will be well represented in the court. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the concerned court and he will be taken into custody.
