Ranjan Singh v. The State of Bihar

CORAM: HONOURABLE MR. JUSTICE AMARESH KUMAR LAL ORAL ORDER 2 09-10-2013 Let the supplementary affidavit filed on behalf of the petitioners be kept on the record. Heard the learned counsel for the petitioners and the learned A.P.P. for the State as well as the learned counsel for the informant. The petitioners are in custody since 30.08.2013 for the offence punishable under Sections 341, 323, 307, 325, 504, 379/34 of the Indian Penal Code. There is allegation of assault to the informant and her husband. It is submitted that there is a case and counter case between both the parties. The husband of the informant and the accused are agnates. Makhdumpur P.S. Case No.310/13 has been lodged by the petitioner no.1 against Awadh Kumar and the members of his family. The injuries have also been found simple Patna High Court Cr.Misc. No.40913 of 2013 (2) dt.09-10-2013 2 in nature. After investigation, no case has been found true under Section 307 of the I.P.C. Considering the facts and circumstances of this case, the above-named petitioners are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in Makhdumpur P.S. Case No.309/2013 with the following conditions :

One of the bailors will be the close relative of the petitioners. The petitioners will not indulge in similar or in any other offence. The petitioners will be well represented in the court. In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bond will be liable to be cancelled by the court concerned. (Amaresh Kumar Lal, J) V.K. Pandey/-
