Learned counsel for the petitioner submits that the bail application has been earlier rejected vide order dated
06.06.2023 in Cr. Misc. 27697 of 2023. In the said case, liberty was granted to the petitioner that he may renew his prayer for bail after framing of the charge in this case.
Counsel for the petitioner submits that charge has already been framed on 06.07.2023 which is Annexure-4. He has also annexed Annexure-3, the development of this case that the informant and the petitioner has filed a compromise petition.
Counsel further submits that the co-accused has been granted bail by the Co-ordinate Bench of this Court vide order dated 28.06.2023 passed in Cr. Misc. No. 27744 of 2023 Patna High Court CR. MISC. No.48465 of 2023(2) dt.02-08-2023
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge-Xth, Aurangabad (arising out of S.Trial No.402 of 2023) in connection with Deo P.S. Case No. 40 of 2023, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
