Heard learned counsel for the petitioner and learned counsel for the Vigilance. The petitioner has again come before this Court for grant of bail with respect to offences under Sections 465, 467, 468, 471, 380, 419, 420 and 120B of the Indian Penal Code and Section 13 (1) (c ) of the Prevention of Corruption Act, 1988 after his earlier prayer for bail was rejected by this Court vide order dated 11.12.2007 passed in Cr. Misc. No. 50973 of 2007. Learned counsel for the petitioner submits that the petitioner has remained in Jail since 25.5.2007 that is about thirteen and half months. It is further submitted that one of the reasons for non-grant of bail on the earlier occasion was that the investigation was still going on in the matter and by now the final charge-sheet has already been submitted on 9.2.2008. It is thus urged that no useful purpose will be served by keeping the petitioner further behind bars. On a consideration of the entire facts and circumstances of the case and specially considering the fact that the petitioner has remained in custody for more than thirteen months, it is directed that the petitioner, Sushil Kumar Sinha, shall be released on bail on furnishing bail bond of Rs. - 2 - 20,000/- (twenty thousand) with two sureties of the like amount each in Special Case No. 46 of 2007, arising out of Gaya Civil Lines P.S. Case No. 114 of 2007 to the satisfaction of the Special Judge Vigilance-I, Patna. P.K. (Ramesh Kumar Dutta,J.)
