JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 01-03-2013 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 33 and 42 of the Forest Act. Tractors and truck loaded with stones booked by Janta Transport, was intercepted when it was found that on the basis of forged challan the stones were being carried. It is alleged that the petitioner is the owner of the truck. It is submitted by learned counsel for the petitioner that admittedly, the stones were being transported at the behest of Janta Transport when the petitioner has given his truck to the Janta Transport on hire. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten Patna High Court Cr.Misc. No.4363 of 2013 (2) dt.01-03-2013 thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Munger in connection with Case No. 18C3/2011, subject to the conditions as laid down under Section 438(2) Cr.P.C.
