IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.14261 of 2010 RADHESHYAM TIWARI . Versus THE STATE OF BIHAR & ORS . ----------- 2/ 03/09/2010 The petitioner has rushed directly to this Court aggrieved by the order of his transfer dated 29.6.2009 placing reliance on Government Circulars regulating transfer and postings. Such circulars only vest a right to represent as held in AIR 2004 SC 2165 (State of U.P. and others v. Gobardhan Lal). Leave is therefore sought to withdraw the application to file a representation before the respondents. This Court expects that notwithstanding the withdrawal of the writ petition, if the employee files a representation based on any circular issued by the State Government, the same shall be duly and appropriately considered in accordance with law within a maximum period of four weeks from the date of receipt/production of a copy of this order along with the representation.
