JUSTICE BIBEK CHAUDHURI ORAL ORDER 2 16-05-2024 The petitioners are contractual Block Horticulture Patna High Court CWJC No.8174 of 2024(2) dt.16-05-2024 Officers. They were appointed on contract basis on 1st October, 2013 and since then they have been working continuously in the same post. On 12th September, 2022, the Directorate of Horticulture, Government of Bihar passed an order stating inter- alia that in accordance with the decision taken by the General Administration Department on 11th September, 2022, which was duly passed by the Cabinet of Bihar State Legislature it was decided that the Block Horticulture Officers, who were appointed on contract basis would continue with their work till their attainment of age of 60 years or till their regular appointment.

The petitioners are aggrieved with the advertisement letter for regular appointment of Block Horticulture Officers (Annexure-P/8) on the ground that in the said advertisement list, the petitioners were not given relaxation of age.

4. Thus, it is submitted by him that the petitioners will Patna High Court CWJC No.8174 of 2024(2) dt.16-05-2024 get relaxation of age till the date upto which they are in service on similar post. In view of such circumstances, the petitioner cannot have any grievance.

5. Learned Y.V. Giri, learned Senior Counsel on behalf of the petitioners next draws my attention to the Government of Bihar, Agricultural Department Notification dated 11th March, 2014 by virtue of which Agriculture Coordinator Cadre (Recruitment & Service Conditions) Rules 2014 was promulgated. He refers to Rule-6 of the said Rules where the age limit for direct recruitment is mentioned.

It is also submitted by the leaned Senior Advocate for the petitioners that since the petitioners have been working as Block Horticulture Officers for more than ten years and the nature of service is akin to regular employment. They may be regularised first and thereafter, the department may initiate the proceeding of direct recruitment. Thus, the petitioners do not want to appear in the open examination on the ground that they have performed their duties as Block Horticulture Officers for continuous period of ten years or more.

7. It is not the law that whenever there is contractual employment, the contractual employees get indivisible right to be regularised. Regularization of contractual employment is an exception to the general Rule. When the contractual employees Patna High Court CWJC No.8174 of 2024(2) dt.16-05-2024 are permitted to compete the recruitment examination and for such competition, the Authority relaxed the age limit, agreed to give weight-age mark for certain years of job, they cannot claim to be employed directly without examination on the basis of their contractual employment.

The decisions of the Hon’ble Supreme Court starting from Uma Devi (3) till Vinod Kumar and Ors. etc. vs. Union of India and Ors. decided on 30th January, 2024 arising out of SLP(C) Nos.22241-42 of 2016 relates to a circumstance where the contractual employees are left out from being appointed in regular cadre. The above mentioned reports are distinguishable with the instant case, because in the instant case, the contractual employees have given the right and permission to appear in the examination by virtue of relaxation of age for the entire period, when they worked as Block Horticulture Officers on contractual employment and thirdly, it is decided to give weight-age to the petitioners at the time of consideration of their selection.

In view of the above circumstances, this Court finds that the petitioners cannot directly claim regular appointment on the basis of their length of service in contractual appointment and accordingly, the prayer made by the petitioners cannot be entertained. 10. It is submitted by the learned senior Advocate for the petitioners that the last date of submission of form has already been expired.

11. Considering the decision of this Court, the Commission is directed to relax the last date of submission of forms for the petitioners by seven days only.

12. The learned Advocate for the State-respondents have raised vehement objection to it.

13. However, this Court is not in a position to accept such objection made by the learned Advocate for the State because of the fact that during this period, the petitioners diligently pursued the instant case with the hope that they will be regularized. If during this period that last date of filling up of forms for direct recruitment expires, the Rule of natural justice demands that they should get a chance to fill up their forms.
