JUSTICE NAVIN SINHA ORAL ORDER 3 18-09-2012 Heard the learned Counsel for the petitioners and the State. It is acknowledged that the name of the petitioners do not figure within the list of 34540 persons approved by the Supreme Court for appointment as Assistant Teacher. But it is submitted that even while prohibiting any Court of law from entertaining objection with regard to non inclusion liberty has been granted the concerned filing representations so that they are not aggrieved during consideration for future vacancy. Learned Counsel submits that the respondents have wrongly classified the year in which the petitioners have obtained their B. Ed. qualification as 1986-87 in place of 1985-86 with regard to petitioner no. 1 and 1`986-87 instead of 1984-85 with regard to petitioner no. 2. This may Patna High Court CWJC No.15825 of 2012 (3) dt.18-09-2012 2 prejudice them during consideration for any future vacancy. Counsel for the respondents submitted that any consideration of the objection has to remain subject to the petitioners otherwise fulfi9lling the eligibility criteria that may be prescribed for such future vacancy.
