Heard learned counsel for the parties. Assailing the impugned order dated 25.9.2012 passed by the District Teachers Employment Appellate Authority hereinafter referred to as the Tribunal, whereby and whereunder, the services of the petitioner as a Panchayat Teacher has been terminated on the ground that the petitioner’s Intermediate qualification obtained from Bhartiya Shiksha Parishad, Lucknow did not fulfil the requirement of eligibility conditions prescribed in the Bihar Patna High Court CWJC No.21606 of 2012 (3) dt.13-12-2013 2 Panchayat Teachers Appointment Rules, 2006, learned counsel for the petitioner has submitted that the Tribunal was influenced by an extraneous material because the letter of the Education Department dated 11.12.2007 was only in respect of training qualification (B.Ed.) of Bhartiya Shiksha Parishad, Lucknow and not with regard to Intermediate qualification. In the considered opinion of this Court, learned counsel for the petitioner does not seen to be correct inasmuch as, the Tribunal has gone into the aspect from all possible angles and in fact had also come to a finding that when the name of Bhartiya Shiksha Parishad, Lucknow was included in the fake institution notified by the University Grant Commission and that the said Bhartiya Shiksha Parishad, Lucknow was not even recognized by the University Grant Commission, this Court will have no difficulty in holding that the petitioner did not possess the requisite qualification of Intermediate as prescribed in Bihar Panchayat Teacher Appointment Rules, 2006, wherein, it has been specifically laid down that such Intermediate qualification by a candidate must have been obtained from a government recognized teaching institution. The Patna High Court CWJC No.21606 of 2012 (3) dt.13-12-2013 3 Government under the 2006 Rules will be the State Government of Bihar and the State of Bihar has not recognized the Bhartiya Shiksha Parishad, Lucknow. The Government in fact could have recognized any such qualification from any recognized University under the UGC Act or any Board of the other States. But so long the recognition as such to the degrees of such institution is conferred by the statutory body in this regard. Pendency of suit can be of no help to the petitioner.
