A counter affidavit has been filed on behalf of the respondent nos. 1 to 7. Learned counsel for the State, with reference to averments made in para 4, contends that admissible dues have already been sanctioned/paid the petitioner. Paragraph no.4 of the counter affidavit enlists the details of payment sanctioned under the head GPF, provisional pension, provisional gratuity, group insurance and leave encashment. From the averments made therein, it appears the petitioner has only been 2 Patna High Court CWJC No.758 of 2010 (6) dt.13-02-2012 authorized provisional gratuity and provisional pension. If that be so, the respondents are obliged to sanction full and final gratuity and pension in favour of the petitioner within 06 weeks from the date of receipt/production of a copy of this order.
