JUSTICE SHAILESH KUMAR SINHA ORAL ORDER 2 17-01-2013 Heard learned counsels for the petitioner and the State. The grievance of the petitioner is that the land as detailed in paragraph 1 of the writ application is being encroached by the private respondents and despite the order passed by the Sub-Divisional Officer although in a proceeding under section 133 of the Code of Criminal Procedure, the Assistant Engineer, Road Construction Department, Rosera Patna High Court CWJC No.6036 of 2012 (2) dt.17-01-2013 was directed to measure the road and take action against the encroachers, however nothing has been done. Petitioner also filed a representation to the above effect to the Executive Engineer as contained in Annexure-7. In the above circumstances, petitioner is permitted to make appropriate representation before the Sub-Divisional Officer, Rosera. In case such representation is filed within a period of three weeks from today stating the relevant details, the representation be considered in accordance with expeditiously preferably within a period of three months on receipt of such representation.
