The present petition has been preferred for the following reliefs: (i) for issuance of a writ in the nature of mandamus directing respondents authority the to concern the pay compensation for the land acquired by the authorities mentioned in paragraph no.6 of the present writ application as per the Patna High Court CWJC No.2076 of 2024(2) dt.16-05-2024 present rate prevailing as per the Right Fair Compensation and Transparency in land, Acquisition, Rehabilitation and Resettlement Act, 2013 read with The Right Fair Compensation and Transparency in Land, Acquisition, Rehabilitation and Resettlement Rules, 2014 and further amendments rate of interest along with litigation cost to the petitioner; (ii) for quashing of (Annexure-6) order dated 29.08.2023 passed by respondent no. 06, Arbitrator-cum- commissioner, Magadh Division, Gaya passed in Arbitration Case No. 115 of 2021 in the matter of Bindeshwari Prasad Yadav Versus the Competent Authority cum Land Acquisition Officer, Nawada and others; (iii) for quashing of (Annexure-5) the award No.29 dated 13.01.2020 in Land Acquisition Case No. 1/19-20 in the name of the petitioner and others, for an amount of Rs. 8,39,813/- for an area of 0.0839 acres of land in the name of the petitioner and his brother award passed by competent authority cum District Land Acquisition officer, Nawada under Plot No. 137, Appertaining to Khata No. 538, situated in Village-Hisua Thana No. 69, P.S.- Hisua, District-Nawada.
This Court has gone through the order of the Patna High Court CWJC No.2076 of 2024(2) dt.16-05-2024 Arbitration-cum-Commissioner, Magadh Division, Gaya in Arbitration Case No. 115 of 2021 (Bindeshwari Prasad Yadav vs the Competent Authority cum Land Acquisition Officer, Nawada and others) and the concluding part of the order read as follows: उपर वरररत तथयो पर रवचारर एवं " अरभलेख मे उपलबध साकयो के अवलोकनोपरांत वादी के वाद आवेदन रदनांक-22.07.2021 के आलोक मे सकम प्रारधकार (NH-82)-सह-रजला भू- अजरन पदारधकारी, नवादा को रनदेश रदया जाता है रक वादी से समनवय सथारपत कर उनकी अरधग्ररहत भूरम यथा खेसरा सं०-137 की Existing geographical situation, Existing use of the land at the time of nitifcation U/s 3A, Already available advantages, like proximity to National or State Highway or road and/or developed area & Market value of other lands situated in the same locality/ village/area or adjacent or very near to the acquired registration land, approved MVR for को दृरषषपथ रखते हु ए यथोरचत एवं युरकतसंगत मुआवजा रनधाररर की रनयमानुकू ल काररवाई की जाय। उकत आदेश/ रवरनशचय के साथ वाद की कायरवाही समापत की जाती है। इसकी एक प्ररत वादी सरहत सकस प्रारधकार-सह-भू अजरन पदारधकारी, नवादा एवं उप महाप्रबंधक (तकरनकी), पररयोजना इकाई NH-82 को Patna High Court CWJC No.2076 of 2024(2) dt.16-05-2024 सूचनाथर एवं आवशयक कायारथर रनबंरधत डाक से भेजते हु ए रनषपारदत अरभलेख यथासथान संधाररत रखा जाय। प्रभारवत पक इस आदेश/ रवरनशचय से असंतु षष होने की रसथरत मे सकम नयायालय की शरर मे जाने के रलए सवतंत्र है।"
