JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 29-03-2012 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a complaint case in which cognizance has been taken under Sections 26, 41, 42 and 2(6) of the Indian Forest Act. The accusation is that two tractors loaded with stones while coming from the protected forest were detected by the Forest Officers when the tractors could not be seized. It is alleged against the petitioners that they were following the tractor on motorcycle. It is submitted by learned counsel for the petitioners that in fact on suspicion the case was lodged as no seizure has been made and for the occurrence of 11.01.2011, the prosecution report was transmitted to the learned CJM on 21.09.2011. Considering the delayed transmission of prosecution report which clouds the bona fide of the accusation, let the above named petitioners be released on anticipatory bail, in Patna High Court Cr.Misc. No.9459 of 2012 (2) dt.29-03-2012 the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Jamui in connection with Complaint Case No. 297C-2 of 2011, subject to the conditions as laid down under Section 438(2) Cr.P.C.
