JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 4 26-08-2013 Counsel for the petitioner and the State are present. The petitioner is widow of late Satish Prasad Verma, who retired as Ex-Motor Operator from the office of District Malaria Officer, Purnea on 30.06.1990. The grievance of the petitioner is that G.P.F. amount was paid on 03.07.1996 without any interest for the intervening period. The State has made out a case that an employee would be entitled to interest from the date of retirement, if application is filed within six months from the date of retirement. In paragraph 8 of the counter affidavit, it is stated that as per GPF Rules, interest is only admissible for six months of the retirement. 2 Patna High Court CWJC No.14618 of 2006 (4) dt.26-08-2013 It is the case of the respondent that the petitioner for the first time filed application for GPF withdrawal on 08.07.1993, almost three years of his retirement and as the application was not proper the same was returned, which was again filed on
07.08.1995. The said application was processed and the G.P.F. amount was paid on 03.07.1996. The counter affidavit does not point deficiencies in the 1st application form. In such circumstances, though I agree with the respondents that petitioner would not be entitled to interest for the period 30.06.1990 to 08.07.1993, nonetheless, he would be entitled to interest from the date of filing of 2nd application i.e. from 08.07.1993 to 07.08.1995 for a period of two years. The respondents would make necessary payment within six months from the date of receipt / production of a copy of this order. With the aforesaid observation, this writ application stands disposed of.
