ORDER:

This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:

.... a Writ of Mandamus to declare the action of the Respondents No.1 and 2 in not registering the FIR in pursuant to the Complaint dated 30-11-2025 made by the Petitioner and not arranging the necessary Police Bandobast in the premises of Sri Ayyappa Swamy Temple, Bukkaraya Samudram, Ananthapur, Ananthapur District till 15-01-2026 in the current Mandala Deeksha season as arbitrary, illegal and violation of Article 14 and 21 of the Constitution of India and contrary to Sec. 175 of BNSS and consequently direct the Respondents No.1 and 2 to register the FIR in pursuant to the Complaint dated 30-11-2025 made by Respondents No.5 to 13 and others and also arrange necessary Police Bandobast in the premises of Sri Ayyappa Swamy Temple, Bukkaraya Samudram, Ananthapur, Ananthapur District till 15-01-2026 to prevent the Respondents No.5 to 13 and others from causing nuisance in the interest of justice.

Sri P.Ajay Babu, learned Assistant Government Pleader for Home would submit that the Police have not registered any crime on the complaint given by the Petitioner in this matter, since their preliminary enquiry reveals that there is a civil suit in O.S.No.76 of 2023 pending between the parties, wherein, the Court ordered status quo. It is further submitted that the matter is purely civil in nature and as such, the Police have not registered any crime. 3

Ms.Y.Bhanusri Akhila, learned counsel for the Petitioner would submit that the Court may pass appropriate orders.
