GP FOR REVENUE The Court made the following: SRK, J W.P.No.22200 of 2026 3 O R D E R Heard the learned counsel for the petitioners, learned Assistant Government Pleader for Panchayat Raj and Rural Development, learned Assistant Government Pleader for Revenue, learned Standing Counsel for Gram Panchayat, and the learned Assistant Government Pleader for Home.

This Writ Petition is filed seeking the following relief: “….to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents 3 to 6 in trying to dispossess and lay road in the property of the petitioners an extent of Ac.0.35 cents situated in Survey No.178/2 and 178/2A, Nallisettipalli Village, Tavanampalli Mandal, Chittoor District, without following due process of law, as arbitrary, illegal, unjust, violative of principles of natural justice, violative of the procedure contemplated under law, violative of the Fundamental Rights guaranteed under Articles 14, 19, 21 and 300A of the Constitution of India, and consequently, direct the respondents not to dispossess and lay road and further not to interfere with petitioners peaceful possession and enjoyment of property an extent of Ac.0.35 cents situated in Survey Nos.178/2 and 178/2A, Nallisettipalli Village, Tavanampalli Mandal, Chittoor District and pass such other order …”

Grievance of the petitioners is that, 1st petitioner is the absolute owner and in possession of land, admeasuring an extent of Ac.0.35 cents situated in Survey No.178/2, Nallisettipalli Village, Tavanampalli Mandal, Chittoor District; that the petitioner No.1 purchased the said property under Registered Sale Deed in the year 1985 and is eking out his livelihood by doing agriculture in the said 4 SRK, J W.P.No.22200 of 2026 land; that for animal husbandry, 1st petitioner constructed a shed in the subject land. In the year 2023, 1st petitioner and his family members gave an extent of Ac.0.18 cents out of the said extent of Ac.0.35 cents to 2nd petitioner; that later sub-division took place, and the name of 2nd petitioner was mutated in revenue records in respect of Ac.0.18 cents in Sy.No.178/2A. (b) It is the grievance of the petitioners that respondent Nos.3 to 6 unlawfully started interfering in the said land and trying to lay down road without any authority; that even after repeated requests, they did not show any document providing for acquisition of the subject land. The respondent Nos.3 to 6, under the instructions of other respondents, on 03.08.2026, at noon hours, without issuing any notice or without following due process of law, came to the subject property, and started clearing the land, by bringing a JCB bearing registration No.AP03 AZ 7659. The issue was subsided at the intervention of police officials. The respondent authorities are trying to lay road by one way or the other. Hence, the Writ Petition.

Today, when the matter has come up before this Court, learned Standing Counsel for Gram Panchayat, on written instructions received from the Nallisettipalli Gram Panchayat, represented by its Panchayat Secretary/Panchayat Development Officer, Nallisettipalli Village, Tavanampalli Mandal, Chittoor District-5th respondent, 5 SRK, J W.P.No.22200 of 2026 submits that this respondent never interfered with the peaceful possession and enjoyment of the petitioners over the subject land in Survey Nos.178/2 and 178/2A of Nallisettipalli Village, and they never brought or deployed any JCB or earth moving machinery for the purpose of laying road or for any other work in the petitioners’ land. He further submits that there is no proposal whatsoever, either pending or under consideration before the respondent No.5-Gram Panchayat to lay any road through the petitioners’ property. He further submits that this respondent had neither passed any resolution nor taken any decision to form a road in the said survey numbers belonging to the petitioners. The written instructions are placed on record.

5. Recording the said submission, the Writ Petition is disposed of. There shall be no order as to costs of the Writ Petition. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition, shall stand closed. JUSTICE K. SREENIVASA REDDY 12th August, 2026.
