#1. This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to declare the action of the respondent No.3 in summoning the petitioners to the police station and threatening to repay Rs.15,00,000 towards advance amount to pay the amount immediately i.e. no time, in pursuant to the Agreement of sale dated 25-11-2019 to the 4th respondent, and thereby causing his interference in the civil disputes, as being illegal, arbitrary and unconstitutional and consequently direct the 1st and 2nd respondents herein to take appropriate action against the 3rd respondent for resorting to indulge in illegal acts of causing his interference in the civil disputes.”
#2. Heard Sri Dr.K.Manmadha Rao, learned counsel for petitioner and the learned Assistant Government Pleader for Home for respondents.
#3. Learned counsel for petitioner would submit the 3rd respondent police are interfering in the civil dispute and pressurizing the petitioner to repay Rs.15,00,000/- towards advance amount immediately.
#4. Learned Assistant Government Pleader for Home respondents, on instructions, would submit that police are not interfering in the civil dispute between the parties and the police never insisted the petitioner to pay an amount of Rs.15,00,000/- to the respondent No.4. 4
#5. Recording the same, the Writ Petition is disposed of. However, police are directed not to interfere in the civil dispute, except under due process of law.
