The preemptees in a proceeding under Section 8 of the Land Reforms Act, 1955 are the petitioners of the instant application under Article 227 of the Constitution of India. The connected J. Misc. Case (Pre-emption) No.26 of 2023 is pending before 3rd Court of the learned Civil Judge (Junior Division) at Tamluk, District: Purba Medinipur. The learned Trial Judge by the order impugned dated May 21, 2024, in exercise of his discretion has accepted the belatedly filed written objection of the petitioners subject to payment of costs of Rs. 800 to the preemptors. This Court is not inclined to interfere with the exercise of such discretion. The order impugned therefore does not call for any interference. C.O. 2953 of 2024 is dismissed without any order as to costs. Urgent Photostat certified copies of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Biswajit Basu, J.)
