Bihani Mr. Mihir Kundu … for the State … for the KMC The order dated 10th August, 2022 passed by the Executive Engineer (Civil), Building Department, Borough-I, Kolkata Municipal Corporation under Section 400(1) of the Kolkata Municipal Corporation Act, 1980 directing demolition of the unauthorised construction is impugned in the present writ petition. The order is an appealable one. Instead of preferring appeal, the petitioners have approached this Court directly, for relief. It will be open for the petitioners to approach the appellate forum to seek relief. The writ petition is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities. 2 ( Amrita Sinha, J.)
