Judgment

Operative part

Mr. Jaydeep Biswas Mr. Kaushik Ghosh Mr. Asraj Mandal ……for the Petitioner. Mr. Biswajit Tiwari Mr. Arka Naha ….for the State. Learned advocate appearing for the petitioner submits that there were recoveries of two semi-automatic pistols from the present petitioner allegedly. Petitioner do not have any other antecedents as is reflected from the documents which have been supplied to the petitioner. He is in custody for more than 6 months. As such petitioner be released on bail as there is no scope of the trial being taken to its logical conclusion. State has placed the case diary. Attention of the Court has been drawn to the seizure list. 2 I find from the seizure list that there were recoveries of Arms from the joint possession of petitioner and another. Apart from two semi-automatic pistols, 6 rounds of live ammunitions were recovered and two empty ammunitions were also recovered. Having considered the nature of the arms which have been recovered and the present stage of the case, I am not inclined to release the petitioner on bail. Accordingly, prayer for bail of the petitioner in CRM (M) 1700 of 2026 is dismissed at this stage. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
