Mr. Rafikul Islam Sardar …for the petitioners This application under Article 227 of the Constitution of India is at the instance of the defendant praying for a direction upon the learned Civil Judge (Jr. Division) at Howrah to dispose of the application for injunction filed in Title Suit No. 41 of 2013 expeditiously. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioners shall be obliged to forward a copy of this application along with this order, upon the opposite party or upon the learned advocate representing the opposite party before the learned trial judge. From the order-sheets appended to this application, this Court finds that February 12, 2025 was fixed for hearing of the injunction application along with the other interlocutory applications. 2 Learned advocate for the petitioners submits that hearing of the aforesaid applications were adjourned to May 21, 2025. In the light of the aforesaid submissions made by the learned advocate for the petitioners, CO 1476 of 2025 is disposed of by requesting the learned Civil Judge (Jr. Division) 4th Court Howrah to take up the hearing of the injunction application on the next date fixed, if the same is otherwise ready for hearing and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. The learned trial judge is requested to dispose of the other interlocutory applications expeditiously. (Hiranmay Bhattacharyya, J.)
