was disposed of by another coordinate Bench of this Court, which granted liberty to the applicants to file their individual 11 representations before the concerned authority, and directed the authority to decide on such representations. Mr. Patra prays for a similar order to be passed on these applications filed by the applicants. Mr. Banerjee, learned advocate appearing for the respondents, vehemently opposes such contention canvassed by Mr. Patra. While explaining the background facts, he submits that initially, three candidates claiming to have worked as substituted Group ‘D’ employees approached the learned Tribunal by preferring an original application (in short, OA), being OA 1317 of 1998, which was disposed of on 21st June, 2009. The learned Tribunal granted liberty to those three applicants to file their individual representations before the respondents for consideration of their individual cases on merits. He submits that despite a specific direction to file individual representations, the applicants filed a consolidated application, which was not attended to. Consequently, the applicants approached the Tribunal again with another original application, being OA 907 of 2022, which was dismissed by an order dated 30th November 2012. Challenging this order, the writ petition, WP.CT 49 of 2013, was filed. The writ petition was disposed of by an order dated 8th April 2013, granting liberty to the petitioners to file individual representations with supporting documents to ventilate their grievances to the concerned authority. Mr. Banerjee submits, upon instruction, that although liberty was given to the writ petitioners in WP.CT 49 of 2013 and the applicants in CAN 8128 of 2014 to file their individual representations, no such representations have been presented as yet. 12 He asserts that such applications cannot be preferred in connection with a writ petition that has already been disposed of. Heard the learned advocates appearing for the respective parties and perused the materials on record. Today, no one appears to represent the writ petitioners. Except for the applicants in the above-noted applications, who are represented by Mr. Patra, the applicants in the other applications are unrepresented. Needless to state that any person who is a necessary or proper party can be added to a proceeding for effective adjudication of the issues involved, but such power can only be exercised during the pendency of that proceeding. After the termination of a proceeding by a final order, an application for the addition of parties cannot be entertained. Consequently, such applications are also not maintainable. As submitted by Mr. Banerjee, the order passed in CAN 8128 of 2014 has not been given effect to by the parties to that application. We find merit in the submissions advanced by Mr. Banerjee that the applications are not maintainable. Accordingly, the applications in which the applicants are represented by Mr. Patra and all other connected applications are dismissed. There shall, however, be no order as to costs.
