The present petitioners have filed an application for getting an order for preemption filed under Section 8 of the West Bengal Land Reforms Act 1955 before the Court of learned Civil Judge (Junior Division), 2nd Court, Hooghly being preemption Misc. Case No. 23 of 2005 against these opposite parties.

Being aggrieved and dissatisfied with the order passed by the learned Trial Court, an appeal was preferred before the First Appellate Court, Hooghly being Misc. Appeal No.11 of 2009. Two applications were filed on behalf of the appellants before the First Appellate Court one of which is under Order 6 Rule 17 and another is under Order 41 Rule 27 of the Code of Civil Procedure. By passing the impugned order, learned First Appellate Court rejected the said two petitions and being aggrieved with the said order, the present revisional application has been filed. 2

It appears that during the pendency of this revisional application, opposite party no.4 was expired and the petitioners were directed to take appropriate step to bring the heirs/legal representatives on record of the said deceased. But no step has yet been taken.

It appears that the present petitioners have lost interest to proceed with this present revisional application. As such, there is no option left but to dismiss the present application.

Accordingly, C.O. 413 of 2010 is, hereby, dismissed for default.

Interim order, if any, stands vacated. There will be no order as to costs. (Prasenjit Biswas, J.)
