Present petition under Article 226 of Constitution of India has been filed seeking the following main relief:- "i. issue a writ, order or direction in the nature of mandamus commanding the State Government (opposite party No.1) to sanction and release pension and post retiral benefits such as, gratuity, GPF, group insurance, earned leave of the petitioner, forthwith in accordance to the provisions as contained under the U.P. Fundamental Rule-56 (e) of the Financial Hand Book Vol. II (Parts-II to IV). ii. issue a writ, order or direction in the nature of mandamus commanding the opposite party No.1 to treat the petitioner as voluntarily retired in accordance to provisions as contained under the U.P. Fundamental Rule-56 (c) & (d) of the Financial Hand Book Vol. II (Parts- II to IV). "

Since considering petitioner's grievance would entail factual aspects, liberty is granted to petitioner to file fresh representation before opposite party no.1, i.e. Principal Secretary, Department of Medical & Health U.P., Lucknow or any other competent authority. In 2 WRIA No. 14865 of 2025 case such a representation is filed, the same is required to be decided by authority concerned expeditiously by a reasoned and speaking order within a period of six weeks from receipt of representation of petitioner along with a certified copy of this order.
