Judgment

Heard learned counsel for the petitioner and learned State Counsel appearing on behalf of the opposite parties.

Present petition under Article 226 of Constitution of India has been filed seeking following main relief:- "(i) Issue a writ, order or direction in the nature of Mandamus directing respondents to revise the pay-scale of petitioner's deceased husband, Late Shri Hari Shankar Singh to Rs.1350-2200 with effect from, 01.01.1986 in accordance with Government Orders dated 09.01.1998 and 20.01.2007 and to grant all consequential benefits, including re-fixation of the family pension payable to petitioner and payment of arrears of family pension accrued therefrom along with applicable interest. "

Learned counsel for petitioner submits that similar benefits have been granted by Department as late as in year 2023 and therefore claim of petitioner is not belated.

Since considering petitioner's grievance would entail factual aspects, liberty is granted to petitioner to file fresh representation before opposite party no.2 i.e. Director, Animal Husbandry Department (Administration & Development), Lucknow. In case such a representation is filed, the same is required to be decided by authority concerned expeditiously by a reasoned and speaking order 2 WRIA No. 13517 of 2025 within a period of eight weeks from receipt of representation of petitioner along with a certified copy of this order.
