4. Vide impugned order dated 27.10.2025 the trial Court rejected the protest petition and the affirmed the final report submitted by the police authorities.
5. Fact(s), in brief, of the case are as under:- (i) Some hot talk took place between the appellant and opposite party No. 2 on 31.08.2024 in the Office of Senior Division Engineer (Air Conditioning), Charbagh, Lucknow at 11:35 hours. (ii) The aforesaid is evident from the application dated 31.08.2024 submitted by the appellant before the Senior Division Engineer (Electric) Air Conditioning, Charbagh, Lucknow. Copy of which is annexed as Annexure No. 1 to the supplementary affidavit dated 19.11.2024. (iii) The aforesaid hot talk took place on account of the fact that the opposite party No. 2 came late in the Office. 2 CRLA No. 3748 of 2025 (iv) It further appears from the aforesaid application dated 31.08.2024 of the appellant that opposite party No. 2 in hot talk hurled abuses and threatened the appellant. Relevant portion of the application dated 31.08.224 reads as under:- "सेवा म(cid:517), थाना (cid:352)भारी, आलमबाग, लखनऊ िवषयः- (cid:361)ी आिशष िसह टे० 1 (cid:497)ारा (cid:352)ाथ(cid:515) के ऊपर जानलेवा हमला करने के स(cid:281)दभ(cid:259) म(cid:517)। महोदय, सिवनय िनवेदन है िक (cid:352)ाथ(cid:515) रमेश कु मार मंडल पद व० ख(cid:276)ड अिभय(cid:281)ता ए०सी आिफस म(cid:517) इंचाज(cid:259) के (cid:627)प म(cid:517) काय(cid:259)रत है (cid:352)ाथ(cid:515) आज िदनाक-31/08/2024 के अपने काया(cid:259)लय चारबाग लखनऊ म(cid:517) िनयिमत (cid:627)प से काय(cid:259) करा रहा था उस समय मेरे आिफस म(cid:517) िन(cid:286)नवत घटना (cid:631)ई। 1-(cid:361)ी आिशष िसह टे(cid:262)नी0-1 पु(cid:347) (cid:361)ी स(cid:281)तराम जाित ठाकु र लगभग 11.35 वजे आिफस आये जबिक आिफस का समय 9 से 17 बजे का है। जब देर से आने से टोका गया तो लडाई करने पर आमदा हो गया तथा उ(cid:289)टी सीधी हरकते करते (cid:631)ए (cid:352)ाथ(cid:515) को गाली गलौज देने लगा एवं जाित सूचक एवं आिदवासी-2 िच(cid:289)लाने लगा। आिशष िसह हमेशा अवैध हिथयार लेकर चलता है एवं हमेशा अ(cid:281)य सुपरवाइजर(cid:523) को धमकता रहता है। आज की घटना की जानकारी अपने (cid:354)ा(cid:281)च अिधकारी Sr. DEE को िदया तो उ(cid:281)ह(cid:523)ने तुर(cid:281)त कम(cid:259)चारी को िनलि(cid:286)बत कर िदया। (cid:352)ाथ(cid:515) को पुनः बताया िक म(cid:520)ने रात म(cid:517) एक सुपरवाइजर SSE के घर पथराव (cid:631)आ है तु(cid:286)हारा भी िनपटारा कर(cid:517)गे। पुनः शायं 6.30 बजे (cid:352)ाथ(cid:515) अपने आवाश ओ(cid:289)ड आर डी0 एस0ओ0 कालोनी म(cid:517) जा रहा था तभी आलमबाग वक(cid:259) शाप के पास लगभग 6, 7 ल(cid:237)के जो िक रा(cid:293)ते म(cid:517) दो, तीन जगह ख(cid:237)े थे िजसम(cid:517) आिशष िसह भी था लोहे की राड से हमला करने लगे तभी राहगीर(cid:523) को िच(cid:289)लाकर मैने रोका और मदद मांगी। जब अिधक राहगीर आ गये तब वे लोग वहा से भाग िनकले। अतः (cid:361)ीमानजी से िनवेदन है (cid:352)ाथ(cid:515) की िशकायत दज(cid:259) कर उ(cid:472) कम(cid:259)चारी के िखलाफ उिचत काय(cid:259)वाही (FIR) दज(cid:259) करने की कृ पा कर(cid:517)। यिद भिव(cid:292)य म(cid:517) मेरे िखलाफ कोई अनहोनी घटना होती है तो उसके िज(cid:286)मेदार आिशष िसह पु(cid:347) (cid:361)ी स(cid:281)तराम पद टे(cid:262)नी 0-1 काया(cid:259)लय व०ख०अ० (वाता) चारबाग मो0नं0-9335882917, 9839256293 ही होगा।" (v) Taking note of contents of the application dated 31.08.2024, the opposite party No. 2 was suspended on the same day i.e. 31.08.2024 and he has not been reinstated till date as appears from the copy of order dated 03.09.2024 annexed as Annexure No. 9 to the appeal. (vi) After the aforesaid the appellant lodged the FIR on 07.09.2024, registered as FIR No. 0160 of 2024 under Sections 115(2), 127(1), 190, 191(2), 352 BNS and 3(1)Da and 3(1)Dha of SC/ST Act, making allegations therein against the opposite party No.2 and also against 6-7 other unknown persons. (vii) In the FIR aforesaid it has been alleged that on 31.08.2024 at about 06:30 PM the opposite party No. 2 alongwith 6-7 unknown persons assaulted 3 CRLA No. 3748 of 2025 the appellant with steel rod while the appellant was going to his home and also hurled abuses and made caste based remarks against the appellant. Relevant portion of the FIR is extracted here-in-under:- "सेवा म(cid:517) (cid:361)ी मान् थाना (cid:352)भारी, आलमबाग, लखनऊ िवषय- (cid:361)ी-आिशष िसह, टेि(cid:262)न0- 1 (cid:497)ारा (cid:352)ाथ(cid:515) के ऊपर जानलेवा हमला करने के स(cid:286)ब(cid:281)ध म(cid:517)। महोदय, सिवनय िनवेटन यह है िक (cid:352)ाथ(cid:515) रमेश कु मार मंडल पद- व०ख०अिभ०, एसी क(cid:523)िचक चारबाग ऑिफस म(cid:517) िडपो इंचाज(cid:259) के पद पर काय(cid:259)रत है। (cid:352)ाथ(cid:515) िदनाक 31.08.2024 को शायं 6:30 बजे अपने आवास ओ(cid:289)ड आर.डी.एस.ओ. कलोनी जा रहा था, तभी अलमबाग वक(cid:259) शप के पास लगभग 6, 7 ल(cid:237)के जो िक रा(cid:293)ते म(cid:517) दो-तीन जगह ख(cid:237)े थे िजसमे आिशष िसह भी था (cid:352)ाथ(cid:515) को रोककर गली गलौज के साथ जाितसूचक श(cid:284)द आिदवासी- आिदवासी बोलते (cid:631)ए लोहे की राड से हमला िकया। तभी (cid:352)ाथ(cid:515) राहगीरो को आवाज लगाकर रोका और मदद मांगी। जब अिधक राहगीर आ गये तब वे लोग वहाँ से भाग िनकला। अतः (cid:361)ी मान से िनवेदन है िक (cid:352)ाथ(cid:515) की िशकायत दज(cid:259) कर उिचत काय(cid:259)वाही करने की कृ पा कर(cid:517)। यिद भिव(cid:292)य मे (cid:352)ाथ(cid:515) के साथ या पिरवार के साथ कोई अनहोनी घटना होती है तो इसके िज(cid:286)मेवार (cid:361)ी आिशष िसह ह(cid:523)गे।" (viii) After lodging of the FIR the Investigating Officer (in short 'I.O.') carried out the investigation and submitted the final report, according to which, no such incident as indicated in the FIR was occurred on 31.08.2024 at about 06:30 PM. (ix) After considering the facts of the case the Court concerned directed the I.O. to submit the fresh final report after taking note of C.C.T.V. footage and C.D.R. as also recording the statement(s) of the witnesses of the prosecution before Camera. (x) After the aforesaid the I.O. submitted that final report dated 19.05.2025 to which appellant preferred protest petition and the trial Court vide impugned order dated 27.10.2025 rejected the same and affirmed the final report. Relevant portion of the order dated 27.10.2025 reads as under:- "प(cid:347)ावली पेश (cid:631)ई। पुकार करायी गयी। वादी के िव(cid:497)ान अिधव(cid:472)ा उपि(cid:293)थत। उनकी ओर से (cid:352)ोटे(cid:293)ट पीिटशन समिथत शपथ प(cid:347) इस आशय का िदया गया है िक नामजद अिभयु(cid:472) आशीष िसह एवं 6 अ(cid:281)य ने वादी को िदनाक 31.08.2024 को मारा पीटा था, जब वह घर जा रहा था और 7 िदन बाद उसकी एफ०आई०आर० आलमबाग थाने म(cid:517) दज(cid:259) (cid:631)ई थी तथा मेिडकल कराया गया था और कोई चोट नह(cid:514) पायी गयी। इसके पहले िववेचक ने िदनांक 02.11.2024 को अंितम िरपोट(cid:259) (cid:352)ेिषत कर दी गयी थी तथा अि(cid:334)म िववेचना के बाद पुनः उ(cid:281)ह(cid:514) सा(cid:296)य(cid:523) के आधार पर अंितम िरपोट(cid:259) (cid:352)ेिषत कर दी गयी है। वादी ने अपने विर(cid:505) अिधकािरय(cid:523) को इस आशय का प(cid:347) (cid:352)ेिषत िकया था िक आशीष िसह झगडालू (cid:352)कृ ित का है और बाहरी लोग(cid:523) को लाकर मारपीट करता है। िदनांक 31.08.2024 को अिभयु(cid:472)गण ने बाहरी लोग(cid:523) अनुराग िम(cid:361)ा, स(cid:277)यजीत िसह, पवन (cid:361)ीवा(cid:293)तव के सम(cid:87) वादी को जान से मारने की धमकी दी थी। यह िक िदनांक 03.09.2024 को सीिनयर डी०ई०ई० ने पुिलस िनरी(cid:87)क, आलमबाग को (cid:352)ेिषत िकया था िक आशीष िसह िनलंिबत कर िदया गया है। यह िक जब वादी ने अिभयु(cid:472) आशीष िसह को यह सूचना दी िक उसका (cid:293)थाना(cid:281)तरण हो गया तब आशीष िसह ने 10-15 अ(cid:88)ात लोग(cid:523) के साथ वादी व अ(cid:281)य इंजीिनयर को मारने की धमकी दी थी। यह िक आशीष िसह के िखलाफ अनेक िशकायते ह(cid:520) िक वह अपने विर(cid:505) अिधकािरय(cid:523) से गाली गलौज व झग(cid:237)ा करता रहता है। यह िक संजय अरो(cid:237)ा ने अपने बयान म(cid:517) यह कहा था िक आशीष िसह और राम सुधीर यादव िदनांक 31.08.2024 को (cid:621)कान पर आये थे। यह िक घटना (cid:293)थल आलमबाग वक(cid:259) शाप के िनकट है, लेिकन िववेचक ने जानबूझकर उसे अ(cid:281)य(cid:347) िदखलाया है। यह िक मोबाइल नंबर की सी०डी०आर० नह(cid:514) ली गयी है तथा न ही धारा 63 4 CRLA No. 3748 of 2025 भारतीय सा(cid:296)य अिधिनयम का (cid:352)माण प(cid:347) िलया गया है। उपरो(cid:472) त(cid:278)य(cid:523) के (cid:623)ि(cid:504)गत यह अनुरोध िकया गया है िक एफ०आर० को िनर(cid:293)त करते (cid:631)ए आशीष िसह को तलब करके दि(cid:276)डत िकया जाये। सुना एवं प(cid:347)ावली का अवलोकन िकया। के स डायरी के पचा(cid:259) नं0 1 म(cid:517) गवाह अनुराग िम(cid:361)ा, स(cid:277)यजीतिसह, पवन (cid:361)ीवा(cid:293)तव अंिकत िकया गया है, िजनके (cid:497)ारा घटना का समथ(cid:259)न नह(cid:514) िकया गया है। इसके अितिर(cid:472) पिरि(cid:293)थितज(cid:281)य सा(cid:87)ी सुरजीत िसह का बयान िववेचक (cid:497)ारा अंिकत िकया गया है, िजसने भी घटना का समथ(cid:259)न िकया है। िववेचक (cid:497)ारा सं(cid:334)िहत सा(cid:296)य से भी (cid:293)प(cid:504) है िक घटना का (cid:293)वत(cid:281)(cid:347) एवं च(cid:291)मदीद सािथय(cid:523) (cid:497)ारा समथ(cid:259)न नह(cid:514) िकया गया है। विणत पिरि(cid:293)थितय(cid:523) म(cid:517) अ०सं० 160/2024 धारा 115(2), 127(1), 190, 352, 191(2) बी०एन०एस० एवं धारा 3(1)10 एस०सी०/एस०टी० ऐ(cid:262)ट थाना-आलमबाग, िजला लखनऊ म(cid:517) (cid:352)(cid:293)तुत अंितम आ(cid:263)या िदनांिकत 19.05.2025 (cid:293)वीकार िकये जाने यो(cid:264)य है और उस पर आधािरत एफ०आर० वाद 402/2025 िन(cid:293)तािरत िकये जाने यो(cid:264)य है। आदेश अंितम आ(cid:263)या िदनांिकत 19.05.2025 (cid:293)वीकार की जाती है एवं उस पर आधािरत एफ०आर० वाद सं(cid:263)या 402/2025 मु०अ०सं० 160/2024 धारा 115(2), 127(1), 190, 352, 191(2) बी०एन०एस० एवं धारा 3 (1)10 एस०सी०/एस०टी० ऐ(cid:262)ट थाना-आलमबाग, िजला लखनऊ त(cid:279)नुसार िन(cid:293)तािरत की जाती है। प(cid:347)ावली िनयमानुसार दािखल द(cid:283)तर हो।"
6. In the aforesaid background of the case, the instant appeal has been filed.
7. Learned counsel for the appellant has impeached the order dated
27.10.2025 on the following ground(s):- (i) Certificate under Section 65(B) was not submitted by the I.O. and despite this the trial Court passed the order impugned. (ii) Statement(s) of witnesses of the prosecution were not recorded before the Camera. (iii) The order impugned is non-speaking and un-reasoned.
8. Learned AGA for the State-Sri Ajay Kumar Srivastava opposed the instant appeal. He stated that the case set up by the appellant in the FIR is completely bogus and it appears that with oblique motive the FIR has been lodged that too with delay of seven days. Prayer is to dismiss the appeal.

Upon due consideration of aforesaid, the material available on record, submissions of the learned counsel for the parties as also the impugned order, this Court finds that no interference is required. It is for the following reason(s):- (i) Application dated 31.08.2024 states that on 31.08.2024 hot talk took place between the appellant and opposite party No. 2 on the issue related to 5 CRLA No. 3748 of 2025 attending the Office with some delay. (ii) Considering the contents of the application dated 31.08.2024 of the appellant as gospel truth the opposite party No.2 was suspended on the same day i.e. 31.08.2024. (iii) The FIR was lodged by the appellant on the basis of written report submitted by him before the S.H.O. concerned on 07.09.2024 and according to the same, the appellant ought to have sustained some grievous injuries as in the FIR it has been indicated that the opposite party No. 2 alongwith 6-7 unknown persons assaulted the appellant with steel rod. However, no injury was sustained by the appellant. (iv) Observations made in the impugned order dated 27.10.2025 that the opposite party No. 2 was present at some other place has not been impeached.

Relevant portion of the order dated 27.10.2025 reads as under:- "प(cid:347)ावली पेश (cid:631)ई। पुकार करायी गयी। वादी के िव(cid:497)ान अिधव(cid:472)ा उपि(cid:293)थत। उनकी ओर से (cid:352)ोटे(cid:293)ट पीिटशन समिथत शपथ प(cid:347) इस आशय का िदया गया है िक नामजद अिभयु(cid:472) आशीष िसह एवं 6 अ(cid:281)य ने वादी को िदनाक 31.08.2024 को मारा पीटा था, जब वह घर जा रहा था और 7 िदन बाद उसकी एफ०आई०आर० आलमबाग थाने म(cid:517) दज(cid:259) (cid:631)ई थी तथा मेिडकल कराया गया था और कोई चोट नह(cid:514) पायी गयी। इसके पहले िववेचक ने िदनांक 02.11.2024 को अंितम िरपोट(cid:259) (cid:352)ेिषत कर दी गयी थी तथा अि(cid:334)म िववेचना के बाद पुनः उ(cid:281)ह(cid:514) सा(cid:296)य(cid:523) के आधार पर अंितम िरपोट(cid:259) (cid:352)ेिषत कर दी गयी है। वादी ने अपने विर(cid:505) अिधकािरय(cid:523) को इस आशय का प(cid:347) (cid:352)ेिषत िकया था िक आशीष िसह झगडालू (cid:352)कृ ित का है और बाहरी लोग(cid:523) को लाकर मारपीट करता है। िदनांक 31.08.2024 को अिभयु(cid:472)गण ने बाहरी लोग(cid:523) अनुराग िम(cid:361)ा, स(cid:277)यजीत िसह, पवन (cid:361)ीवा(cid:293)तव के सम(cid:87) वादी को जान से मारने की धमकी दी थी। यह िक िदनांक 03.09.2024 को सीिनयर डी०ई०ई० ने पुिलस िनरी(cid:87)क, आलमबाग को (cid:352)ेिषत िकया था िक आशीष िसह िनलंिबत कर िदया गया है। यह िक जब वादी ने अिभयु(cid:472) आशीष िसह को यह सूचना दी िक उसका (cid:293)थाना(cid:281)तरण हो गया तब आशीष िसह ने 10-15 अ(cid:88)ात लोग(cid:523) के साथ वादी व अ(cid:281)य इंजीिनयर को मारने की धमकी दी थी। यह िक आशीष िसह के िखलाफ अनेक िशकायते ह(cid:520) िक वह अपने विर(cid:505) अिधकािरय(cid:523) से गाली गलौज व झग(cid:237)ा करता रहता है। यह िक संजय अरो(cid:237)ा ने अपने बयान म(cid:517) यह कहा था िक आशीष िसह और राम सुधीर यादव िदनांक 31.08.2024 को (cid:621)कान पर आये थे। यह िक घटना (cid:293)थल आलमबाग वक(cid:259) शाप के िनकट है, लेिकन िववेचक ने जानबूझकर उसे अ(cid:281)य(cid:347) िदखलाया है। यह िक मोबाइल नंबर की सी०डी०आर० नह(cid:514) ली गयी है तथा न ही धारा 63 4 CRLA No. 3748 of 2025 भारतीय सा(cid:296)य अिधिनयम का (cid:352)माण प(cid:347) िलया गया है। उपरो(cid:472) त(cid:278)य(cid:523) के (cid:623)ि(cid:504)गत यह अनुरोध िकया गया है िक एफ०आर० को िनर(cid:293)त करते (cid:631)ए आशीष िसह को तलब करके दि(cid:276)डत िकया जाये। सुना एवं प(cid:347)ावली का अवलोकन िकया। के स डायरी के पचा(cid:259) नं0 1 म(cid:517) गवाह अनुराग िम(cid:361)ा, स(cid:277)यजीतिसह, पवन (cid:361)ीवा(cid:293)तव अंिकत िकया गया है, िजनके (cid:497)ारा घटना का समथ(cid:259)न नह(cid:514) िकया गया है। इसके अितिर(cid:472) पिरि(cid:293)थितज(cid:281)य सा(cid:87)ी सुरजीत िसह का बयान िववेचक (cid:497)ारा अंिकत िकया गया है, िजसने भी घटना का समथ(cid:259)न िकया है। िववेचक (cid:497)ारा सं(cid:334)िहत सा(cid:296)य से भी (cid:293)प(cid:504) है िक घटना का (cid:293)वत(cid:281)(cid:347) एवं च(cid:291)मदीद सािथय(cid:523) (cid:497)ारा समथ(cid:259)न नह(cid:514) िकया गया है। विणत पिरि(cid:293)थितय(cid:523) म(cid:517) अ०सं० 160/2024 धारा 115(2), 127(1), 190, 352, 191(2) बी०एन०एस० एवं धारा 3(1)10 एस०सी०/एस०टी० ऐ(cid:262)ट थाना-आलमबाग, िजला लखनऊ म(cid:517) (cid:352)(cid:293)तुत अंितम आ(cid:263)या िदनांिकत 19.05.2025 (cid:293)वीकार िकये जाने यो(cid:264)य है और उस पर आधािरत एफ०आर० वाद 402/2025 िन(cid:293)तािरत िकये जाने यो(cid:264)य है। आदेश अंितम आ(cid:263)या िदनांिकत 19.05.2025 (cid:293)वीकार की जाती है एवं उस पर आधािरत एफ०आर० वाद सं(cid:263)या 402/2025 मु०अ०सं० 160/2024 धारा 115(2), 127(1), 190, 352, 191(2) बी०एन०एस० एवं धारा 3 (1)10 एस०सी०/एस०टी० ऐ(cid:262)ट थाना-आलमबाग, िजला लखनऊ त(cid:279)नुसार िन(cid:293)तािरत की जाती है। प(cid:347)ावली िनयमानुसार दािखल द(cid:283)तर हो।"
6. In the aforesaid background of the case, the instant appeal has been filed.
7. Learned counsel for the appellant has impeached the order dated
27.10.2025 on the following ground(s):- (i) Certificate under Section 65(B) was not submitted by the I.O. and despite this the trial Court passed the order impugned. (ii) Statement(s) of witnesses of the prosecution were not recorded before the Camera. (iii) The order impugned is non-speaking and un-reasoned.
8. Learned AGA for the State-Sri Ajay Kumar Srivastava opposed the instant appeal. He stated that the case set up by the appellant in the FIR is completely bogus and it appears that with oblique motive the FIR has been lodged that too with delay of seven days. Prayer is to dismiss the appeal.

Upon due consideration of aforesaid, the material available on record, submissions of the learned counsel for the parties as also the impugned order, this Court finds that no interference is required. It is for the following reason(s):- (i) Application dated 31.08.2024 states that on 31.08.2024 hot talk took place between the appellant and opposite party No. 2 on the issue related to 5 CRLA No. 3748 of 2025 attending the Office with some delay. (ii) Considering the contents of the application dated 31.08.2024 of the appellant as gospel truth the opposite party No.2 was suspended on the same day i.e. 31.08.2024. (iii) The FIR was lodged by the appellant on the basis of written report submitted by him before the S.H.O. concerned on 07.09.2024 and according to the same, the appellant ought to have sustained some grievous injuries as in the FIR it has been indicated that the opposite party No. 2 alongwith 6-7 unknown persons assaulted the appellant with steel rod. However, no injury was sustained by the appellant. (iv) Observations made in the impugned order dated 27.10.2025 that the opposite party No. 2 was present at some other place has not been impeached.
