This petition has been filed with the following main prayer :- "(i) Issue a writ, order or direction in the nature of mandamus commanding and directing the opposite party no.1 to take final decision on the fact finding report dated 06.05.2024 as contained in Annexure no.3 to this writ petition) submitted by the opposite party no.2 vide his letter dated 13.06.2024 on which the Show Cause Notice dated 27.08.2024 was issued to the opposite party no.2 U/S 48 of the U.P. Municipalities Act, 1916, as contained in Annexure no.4 to this writ petition, within such time bound period as may be deemed fit, just and proper and fixed by this Hon'ble Court. "

Learned Counsel for the petitioner has pointed out our earlier order dated 09.12.2025.

Learned Standing Counsel has produced before this Court instructions dated 15.12.2025 sent by the Under Secretary, Government of U.P., wherein it has been stated that the enquiry is still continuing against Smt. Shabana Khatoon, Chairperson, Nagar Panchayat Belhara. The said 2 WRIC No. 11023 of 2025 enquiry was ordered by the State Government and the District Magistrate was asked to submit a report on 21.10.2025. The District Magistrate has submitted a report on which the action is now to be taken by the State Government and it is under consideration.

The writ petition is disposed of with a direction to the respondent no.1 to take an appropriate decision on the report submitted by the District Magistrate, after giving opportunity of hearing to the respondent no.5- Chairman, Nagar Panchayat Belhara, Barabanki, on the points clarified by the District Magistrate Barabanki, within a period of two months from the date a copy of this order is produced before him.
