Judgment

situated 3 Kms. Away at the Village- Pandit Purwa, and ii. to issue a writ, order or direction in the nature of Mandamus commanding the opposite parties to consider and decide the representation of the petitioner for permitting all the voters of the Village- Nakaha to cost their votes at the Polling Centre situated at the Village-Nakaha itself in lieu of the Polling Centre situated 3 Kms. Away at the Village- Pandit Purwa, and iii. to pass any other suitable order or direction in favour of the petitioner in public interest and against the opposite parties named above which this Hon'ble Court may deem just and proper in circumstances of the case, and 2 WPIL No. 1084 of 2025 iv. to allow the instant writ petition with cost through out. "

The elections to Gram Pranchayat are yet to be notified. Voter-list is being prepared. As per learned Standing Counsel, there are two polling stations and six polling booth in the village of the petitioner. Facility of casting vote is available at polling centre situated at village-Nakaha apart from Village-Pandit Purwa also, therefore, no prejudice is cause to the matter.

These are not the matters to be considered by the writ court under Article 226 of the Constitution of India but for the authorities to consider at the appropriate time provided there is a cause. As of now, learned Standing Counsel says that facility of voting is available in the village of the petitioner, but the petitioner says some villagers are asked to vote at Pandit Purwa. If there is any grievance, petitioner can approach the District Election Officer concerned who may look into the matter as per law.
