1. Shri S.P. Tiwari, learned AGA for the State and perused the record. The present criminal revision under Section 397/401 of Criminal 2. Procedure Code, 1973 (akin to Section 438/442 of BNSS, 2023) has been filed by revisionists Niranjan S/o late Khuman, Guddi W/o Niranjan, Kaushal Kumar @ Malikhe S/o Niranjan, Jaswant S/o Niranjan and Shubham Kumar S/o Niranjan impeaching the order dated 27.02.2025, passed by the Session Judge, Hardoi (in short "Trial Court") in Session Case No.1466 of 2024 (State Vs. Niranjan and others) by which the application seeking discharge has been rejected by the trial court. The relevant portion of the order reads as under :- "प्ቔावली के परि(cid:11)शीलन से स्प्ቖ है किक वादी मुकदमा हेमनाथ की ओ(cid:11) से किदनांक 08.09.2024 को समय 21.41 बजे थाना कासिसमपु(cid:11) सिजला ह(cid:11)दोई में इस आशय की तह(cid:11)ी(cid:11) ्ቚस्तुत की गयी किक बादी मुकदमा हेमनाथ पु्ቔ (cid:11)्ቈी(cid:11)ाम किनवासी ्ቇाम महमूदपु(cid:11) धतितगड़ा थाना कासिसमपु(cid:11) सिजला ह(cid:11)दोई का किनवासी है। उसके गाँव किनवासी गु्ቂी पत्नी किन(cid:11)ंजन ने किदनांक 01.09.2024 को उसके घ(cid:11) प(cid:11) आक(cid:11) गाली-गलौज क(cid:11)ने लगी। गाली-गलौज सुनक(cid:11) वादी मुकदमा के किपता (cid:11)्ቈी(cid:11)ाम पु्ቔ सुक्खा ने घ(cid:11) से बाह(cid:11) किनकलक(cid:11) इन लोगों को गाली-गलौज क(cid:11)ने से मना किकया। तभी अचानक घ(cid:11) के बाह(cid:11) खड़े किन(cid:11)ंजन पु्ቔ खुमान, कौशल उ्ቛ; मलिलखे पु्ቔ किन(cid:11)ंजन, जसवंत पु्ቔ किन(cid:11)ंजन, शुभम पु्ቔ किन(cid:11)ंजन, (cid:11)ामजी पु्ቔ सजीवन लाल, श्यामजी पु्ቔ सजीवन लाल सव; किनवासी महमूदपु(cid:11) धतितगड़ा थाना कासिसमपु(cid:11) एक(cid:11)ाय होक(cid:11) हाथों में लाठी, डंडा व ्ቛावड़ा आकिद लिलए हुए उसके किपता के ऊप(cid:11) जान से मा(cid:11)ने की नीयत से हमला क(cid:11) किदया। उसके किपता के (cid:11)ोने तिच्ቤाने की आवाज सुनक(cid:11) वादी, उसका भाई दयाशंक(cid:11) एवं पड़ोस में 2 (cid:11)हने वाले मुंशीलाल पु्ቔ सुक्खा, उनको बचाने दौड़े तो उन लोगों ने उन प(cid:11) भी लाठी डंडों से हमला क(cid:11) किदया। इन लोगों ने घे(cid:11)क(cid:11) उसके किपता को लांठी, डंडों औ(cid:11) ्ቛावड़े से बहुत मा(cid:11)ा। उसके किपता, इन लोगों की किपटाई से लहुलुहान म(cid:11)णास्ቐ होक(cid:11) जमीन प(cid:11) किग(cid:11) गए। उसके किपता को लहूलुहान औ(cid:11) बेहोश देखा तो मृत समझक(cid:11) उ्ሹ सभी उन लोगों को भी जान से मा(cid:11)ने औ(cid:11) गाँव में न (cid:11)हने की धमकी देते हुए मौके से भाग गये। वादी मुकदमा म(cid:11)णास्ቐ किपता को लेक(cid:11) सव;्ቚथम तु(cid:11)ंत थाना कासिसमपु(cid:11) आया। थाने से उसके बेहोश म(cid:11)णास्ቐ किपता औ(cid:11) चोटकिहल उसके भाई आकिद को मेतिडकल के लिलए सी०एच०सी० बेंहद(cid:11) भेज किदया गया। जहाँ किपता की हालत अत्यंत नाजुक देखक(cid:11) तिचकिकत्सकों ने सिजला तिचकिकत्सालय ह(cid:11)दोई औ(cid:11) कि्ቛ(cid:11) ह(cid:11)दोई से मेतिडकल कालेज ट्रामा सेंट(cid:11) के लिलए (cid:11)े्ቛ(cid:11) क(cid:11) किदया। 01 सिसतंब(cid:11) 2024 से ट्रामा सेंट(cid:11) मेतिडकल कालेज में म(cid:11)णास्ቐ ቝኌस्थतित में इलाज(cid:11)त उसके किपता की किदनांक 08 सिसतंब(cid:11) 2024 को मृत्यु हो गयी है। किवप्ቌी गाँव के ्ቚधान हैं औ(cid:11) दबंग ्ቚवृलि्ቈ के हैं। पैसे की ताकत प(cid:11) हमको ड(cid:11)ा (cid:11)हे हैं। अतः काय;वाही किकए जाने की याचना की गयी है। वादी मुकदमा ्ቛा(cid:11)ा उ्ሹ आशय की ्ቚस्तुत तह(cid:11)ी(cid:11) के आधा(cid:11) प(cid:11) किदनांक 08.09.2024 को समय 21.41 बजे थाना कासिसमपु(cid:11) सिजला ह(cid:11)दोई में अंतग;त धा(cid:11)ा 191(2), 191(3), 105, 115 (2), 352, 351 (2) बी०एन०एस० में ्ቚथम सूचना रि(cid:11)पोट; पंजीकृत की गयी। किकन्तु दौ(cid:11)ान किववेचना किववेचक ्ቛा(cid:11)ा धा(cid:11)ा 105 बी०एन०एस० का अप(cid:11)ाध न बनने के का(cid:11)ण उ्ሹ ्ቚक(cid:11)ण में धा(cid:11)ा 105 बी०एन०एस० किवलोकिपत क(cid:11)ते हुए धा(cid:11)ा 103 (1) बी०एन०एस० की बढो्ቈ(cid:11)ी की गयी है। किववेचना के अनु्ቅम में ही इस घटना में वादी मुकदमा हेमनाथ के किपता (cid:11)्ቈी(cid:11)ाम की मृत्यु होने के उप(cid:11)ांत उसका पोस्टमाट;म क(cid:11)ाया गया। मृतक (cid:11)्ቈी(cid:11)ाम की पोस्टमाट;म आख्या में उसके श(cid:11)ी(cid:11) प(cid:11) किनम्नलिललिखत चोटें पायी गयीं :-

1. Stitched wound 3cm long along with 3 stitches present on left side of forehead, 4cm above left eyebrow.

2. Stitched wound (semi circular in shape) 28cm long along with 32 stitches, present on left side of head, just above left ear. On opening ecchymosis present underneath all above the mentioned injuries. Surgical craniotomy present on left temporal and parietal region, meningies reparied. Craniotomy bone missing. Sub dural hematoma present all over the brain. तिचकिकत्सक की (cid:11)ाय के अनुसा(cid:11) मृतक की मृत्यु, मृत्यु पूव; सिस(cid:11) में आयीं इन्ही चोटों से उत्प्ቐ COMA के का(cid:11)ण होना बताया गया है। इसके अतितरि(cid:11)्ሹ इस घटना में वादी का चाचा मुंशीलाल /चोटकिहल एवं उसका भाई दयाशंक(cid:11)/चोटकिहल का भी तिचकिकत्सीय प(cid:11)ी्ቌण क(cid:11)ाया गया, सिजसमें उनके श(cid:11)ी(cid:11) प(cid:11) किनम्नलिललिखत चोटें पायी गयीं :- Injured Munshilal

1. Contusion 4cm x 2cm on the left hand elbow.

2. Complain of pain in body. Injured Dayashankar

1. Lacerated wound 1cm x 2cm on the left hand index finger proximal phalanx dorsal side.

2. Lacerated wound 1cm x 0.2cm on the left hand index finger.

3. Lacerated wound 1cm x 0.1cm on the right hand. 3

4. Complaint of pain in left forearm. इस ्ቚका(cid:11) किववेचक ्ቛा(cid:11)ा केस डाय(cid:11)ी में इस आशय का साቌኚय संकलिलत किकया गया है किक अभिभयु्ሹगण किन(cid:11)ंजन, गु्ቂी, कौशल किकशो(cid:11) उ्ቛ; मलिलखे, जसवन्त, शुभम, (cid:11)ामजी एवं श्यामजी ने एक (cid:11)ाय होक(cid:11) पु(cid:11)ानी मुकदमेबाजी की (cid:11)ंसिजश को लेक(cid:11) घटना की किदनांक को वादी मुकदमा हेमनाथ, उसके किपता (cid:11)्ቈी(cid:11)ाम, उसके चाचा दयाशंक(cid:11) एवं उसके भाई दयाशंक(cid:11) को लाठी, ्ቛावड़ा व लोहे की (cid:11)ॉड से गाली गलौज क(cid:11)ते हुए मा(cid:11)ापीटा, सिजसमें वादी मुकदमा के किपता (cid:11)्ቈी(cid:11)ाम के सिस(cid:11) प(cid:11) दो गंभी(cid:11) चोटें आयी औ(cid:11) वह म(cid:11)णास्ቐा ቝኌस्थतित में हो गया तथा दौ(cid:11)ान इलाज किदनांक 16.08.2024 को के०जी०एम०यू०, लखनऊ में उसकी मृत्यु हो गयी। मृतक (cid:11)्ቈी(cid:11)ाम का के० जी० एम० यू० लखनऊ में ही पोस्टमाट;म किकया गया। मृतक के पोस्टमाट;म रि(cid:11)पोट; में उसके सिस(cid:11) प(cid:11) दो चोटें पायी गयीं औ(cid:11) तिचकिकत्सक की (cid:11)ाय के अनुसा(cid:11) मृतक की मृत्यु, मृत्यु पूव; सिस(cid:11) में आयीं इन्ही चोटों से उत्प्ቐ COMA में जाने के का(cid:11)ण होना बताया गया है। किववेचक ्ቛा(cid:11)ा इस घटना में वादी मुकदमा हेमनाथ एवं चोटकिहल उसके भाई दयाशंक(cid:11) एवं उसके चाचा मुंशीलाल का बयान अंतग;त धा(cid:11)ा 180 बी०एन०एस० लिलया गया है। उ्ሹ चोटकिहल साति्ቌयों ने अपने बयानों में अभिभयोजन कथानक का समथ;न किकया है। इसके अतितरि(cid:11)्ሹ किववेचक ्ቛा(cid:11)ा चश्मदीद सा्ቌी सु(cid:11)ेश, सू(cid:11)ज एवं श(cid:11)मा देवी के बयान अंतग;त धा(cid:11)ा 180 बी०एन०एस०एस० लिलयं० गये हैं। उ्ሹ साति्ቌयों ने भी अपने बयान में अभिभयोजन कथानक का समथ;न किकया है। इसके अतितरि(cid:11)्ሹ बहस के दौ(cid:11)ान अभिभयु्ሹगण के किव्ቛान अतिधव्ሹा की ओ(cid:11) से तक; किकया गया था किक मामला ्ቅास केस का भी है। किकन्तु यह किवचा(cid:11)ण के समय तय किकया जा सकेगा किक कौन प्ቌ अ्ቇस(cid:11) था। इस स्त(cid:11) प(cid:11) किववेचक ्ቛा(cid:11)ा की गयी संपूण; किववेचना से अभिभयु्ሹगण के किवरू्ቍ आ(cid:11)ोपप्ቔ में वቓኌणत धा(cid:11)ाओं 191 (2), 191(3), 103(1), 115(2), 352, 351(2) बी०एन०एस० में आ(cid:11)ोप किव(cid:11)तिचत क(cid:11)ने का साቌኚय ्ቚथम दृ्ቖया प्ቔावली प(cid:11) उपलब्ध है। इस ्ቚका(cid:11) उप(cid:11)ो्ሹ किववेचन, केस डाय(cid:11)ी में अंकिकत साति्ቌयों के बयान अंतग;त धा(cid:11)ा 180 बी०एन०एस०एस०, पोस्टमाट;म आख्या, चोटकिहलों की तिचकिकत्सीय आख्याओं के परि(cid:11)शीलनोप(cid:11)ांत न्यायालय इस किनष्क्ቧ; प(cid:11) पहुंचता है किक सभी अभिभयु्ሹगण किन(cid:11)ंजन, गु्ቂी, कौशल किकशो(cid:11) उ्ቛ; मलिलखे, जसवन्त, शुभम, (cid:11)ामजी एवं श्यामजी के किवरू्ቍ आ(cid:11)ोपपप्ቔ में वቓኌणत ध(cid:11)ाओं 191(2), 191(3), 103(1), 115(2), 352, 351 (2) बी०एन०एस० में आ(cid:11)ोप किव(cid:11)तिचत किकए जाने का पया;्቎ साቌኚय उपलब्ध है। अतः प्ቔावली किदनांक 03.03.2025 को वास्ते किव(cid:11)तिचत किकए जाने आ(cid:11)ोप पेश हो।"

Upon due consideration of the arguments advanced by learned counsel for the parties and the documents available on record including the statement of injured persons namely Daya Shanker S/o Late Rati Ram and Munshi Lal S/o Sukha, this Court finds that following facts are relevant :- (i) The injured persons namely Dayashanker S/o late Rati Ram and Munshi Lal S/o Sukha, have indicated the names of the revisionists before the Investigating Officer (in short "I.O."). According to the statement of these witnesses recorded by the I.O. the revisionists were involved in the crime. 4 The statements of these witnesses indicate that specific role (ii) has been assigned to Shubham and Ramji. It is to be noted that the evidence/testimony of the injured (iii) witnesses has greater evidentiary value and unless compelling reasons exist, their statements are not to be discarded lightly as observed by the Hon'ble Apex Court in the case (s) of State of M.P. vs. Mansingh, (2003) 10 SCC 414; Abdul Sayeed vs. State of M.P., (2010) 10 SCC 259; State of U.P. vs. Naresh, (2011) 4 SCC 324; Laxman Singh vs. State of Bihar (Now Jharkhand) (2021) 9 SCC 191 and Balu Sudam Khalde and another vs. State of Maharashtra, 2023 SCC OnLine SC 355. (iv) From the side of the revisionists an F.I.R. was lodged on 01.09.2024 by Smt. Guddi (revisionist No.2) making allegations against Suraj, Suresh, both S/o Harish Chandra and Munshi Lal, Rati Ram (deceased) both S/o Sukha, registered as Case Crime No.0300 of 2024, under Sections 115(2), 352, 351(2), 109, 125 of BNS, 2023 at Police Station - Kasimpur, District - Hardoi and at the same Police Station F.I.R. No.0309 of 2024 was lodged on 08.09.2024 by the opposite party No.2 and according to both these F.I.R.s the incident occurred on 01.09.2024 at 7.00 A.M.

4. Upon due consideration of the aforesaid and also the law as laid down by the Hon'ble Apex Court in the case of Amit Kapoor v. Ramesh Chander, (2012) 9 SCC 460; Tarun Jit Tejpal Vs. State of Goa and Another, 2019 SCC OnLine SC 1053; State of Gujarat vs. Dilipsinh Kishorsinh Rao reported in 2023 SCC OnLine SC 1294; Vishnu Kumar Shukla v. State of U.P., 2023 SCC OnLine SC 1582; Hazrat Deen vs. State of Uttar Pradesh and Another; reported in 2022 SCC OnLine SC 1781, wherein the Hon'ble Apex Court has settled the principles with regard to dealing with an application seeking discharge, this Court is not inclined to interfere in the present case.
