"1.Heard Sri Vaibhav Shukla, learned counsel for the petitioners and Sri G.D. Bhatt, learned AGA for the State.

2. Issue notice to opposite party Nos 4 & 5.

3. Steps be taken within a week.

4. Office to proceed accordingly.

5. By means of this petition, petitioners have prayed for following reliefs: "(i). Issue a writ or mandamus or any other appropriate writ, order or direction to the respondents to have the C.B.I. or any other independent investigative agency to take over the investigation and prosecution with respect to the complaints made by the petitioners with respect to the abduction of the petitioner's daughter in law and in this petition. (ii). Issue writ, order or direction in the nature of mandamus directing opposite party/investigating agency conduct prompt, impartial and fair investigation in FIR dated 04.03.2021 registered as crime No.70/2024 under Section 364 of I.P.C. relating to Police Station Sandila, District Hardoi, in the interest of justice. (iii). Issue writ, order or command in the nature of mandamus directing opposite party No.1 & 2 to take prompt action to restrict the accused persons and 3 CRLP No. 7404 of 2025 investigating officer to not further threaten the petitioner and family members in aforesaid crime number during the pendency of this petition in the interest of justice."

6. Sri Bhatt, learned AGA has produced the instructions letter

27.08.2025 provided by one Santosh Kumar Singh, Circle Officer, Police Station Sandila District Hardoi addressing the Government Advocate, same is taken on record.

7. As per the aforesaid instructions, investigating agency is trying to trace out the location of the lady, who is missing since 06.08.2023.

8. This is really surprising fact that in last more than two years, the investigating agency is only trying to trace out the location of the lady and no fruitful result could be achieved till date, therefore, by the date the Superintendent of Police, Hardoi shall file his personal affidavit apprising the Court about the progress of the investigation and efforts so taken by the Investigating Officer, failing which the Superintendent of Police, Hardoi shall appear in person. However, Station House Officer, Police Station Sandila District Hardoi shall appear in person on the next date alongwith case diary to assist the Court.

9. List this case on 10th September, 2025. "

3. In compliance of the aforesaid order, Sri Vidhya Sagar Pal, S.H.O. Police Station Sandila District Hardoi is present in person. 4 CRLP No. 7404 of 2025

4. The Superintendent of Police, Hardoi has filed his personal affidavit, same is taken on record.

5. Learned counsel for the petitioner may file reply to the personal affidavit by the next date of listing.

6. As per the officer, who is present in person, after tracing out the location of the lady, who is missing since 06.08.2023 one special team has been sent to the Mumbai. One more team would be sent to Bhatinda (Punjab) as there is likelihood that the missing lady might have gone to Bhatinda (Punjab) with one person living at Mumbai. In any case, to trace out the location of the lady, at least two to three weeks' time may take place. The S.H.O. has assured the Court that if, he is given three weeks time, the information in respect of missing lady may be provided to the Court.

7. List this case on 06.10.2025. On that date, the officer who is present in person, shall again appear in person to apprise the fact as to whether the missing lady has been traced out or not.

8. If, the proper information is not provided to the Court on the next date, the Superintendent of Police concerned may be summoned on the next date."

In pursuance thereof, the matter was listed on 06.10.2025 on which date the S.H.O., Police Station Sandila, District Hardoi was present and he had stated that the body of the lady has been traced out and has also been identified by the family of the deceased and that the D.N.A. report could also be required.

7. In paragraph 11 of the personal affidavit filed today, it is has been indicated that the D.N.A. report has been received as per which the corpus has been identified as that of Ms. Sonam and the D.N.A. matches with her mother Ms. Chandrawati.

8. It has also been indicated in the personal affidavit that three accused have already been arrested and attempts are being made to arrest the fourth accused. 5 CRLP No. 7404 of 2025

9. Considering the aforesaid, it is apparent that the respondents have proceeded in pursuance to the F.I.R. which has been lodged by the petitioner No.1 and also conducting the investigation and certain persons have already been arrested.

10. Accordingly, the writ petition is disposed of in view of the above.
