2. This Criminal Revision under Section 19 (4) of the Family Court Act, 1984 has been filed impeaching the judgment and order dated 03.06.2025, passed by the Principal Judge, Family Court, Ambedkar Nagar (in short "Family Court") in Maintenance Petition No.50 of 2022 (Shakuntala Devi and others Vs. Sanjay Kumar) filed under Section 125 Cr.P.C.
3. By the impugned, the Family Court has directed the revisionist to pay Rs.5000/- as maintenance to the opposite party No.2 and Rs.2500/- each to the opposite party Nos. 3 and 4.
For coming to the conclusion on the prayer sought this court took 4. note of the facts of the case as also the observations made by the Family Court in the impugned order dated 03.06.2025.
5. A case i.e. Maintenance Petition No.50 of 2022 (Computerized Case No.69 of 2022) (Shakuntala and others Vs. Sanjay Kumar) was filed by the opposite party Nos.2, 3 and 4 (in short "claimants", who are wife and two minor children, aged about 13 and 8 years respectively). Before the Family Court, regarding the income of the revisionist, 6. the claimants stated that the present revisionist is earning Rs.70,000/- per month, which could not be established by the claimants before the Family Court.

The Family Court taking note of the statement of the revisionist according to which the revisionist is earning by discharging the duties of the post of Guard/Watchman at Police Station Akhand Nagar, District Sultanpur as also having agricultural land, the Family Court directed the revisionist to pay Rs.5,000/- to the opposite party No.2- Shakuntala (wife 2 of the revisionist) and Rs.2,500/- each to the two children namely Parul (daughter) and Prakhar (son). The present revision has been filed based upon the ground that the 8. opposite party No.2 is an earning lady and therefore, the Family Court in awarding Rs.5,000/- per month as maintenance to the opposite party No.2 has erred in law. On the aforesaid aspect of the case, this Court took note of the 9. observations made by the Family Court in paragraph 11 of the order under challenge, which, for ready reference, is extracted herein under :- "11. नि(cid:2)स्तारण अवधा्(cid:13) ्ቚ् संख््ा- (1) अवधा्(cid:13) ्ቚ् संख््ा-1 इस आश् का निवरचि(cid:24)त निक्ा ग्ा है निक क््ा परिरवानि(cid:31)्ागण अप(cid:2)ा भरण-पोषण कर(cid:2)े में असम्ቕ(cid:13) है ? परिरवानि(cid:31)्ा संख््ा-1 (cid:2)े अप(cid:2)े भरण-पोषण परिरवा(cid:31) के ्ቚस्तर 10 में तथ्् ्ቚकट निक्ा है निक वह नि(cid:31)(cid:2)ांक-20.05.2016 से अप(cid:2)े माता-निपता के घर अप(cid:2)े (cid:31)ो(cid:2)ो (cid:2)ाबालि,ग ब्ሴों के सा्ቕ आभाव में जी रही है। सा्ቕ ही परिरवा(cid:31) के ्ቚस्तर 12 में तथ्् ्ቚकट निक्ा है निक परिरवानि(cid:31)्ा संख््ा-1 असहा् मनिह,ा है जो स्व्ं अप(cid:2)ा व अप(cid:2)े (cid:2)ाबालि,ग ब्ሴों को जीव(cid:2) नि(cid:2)वा(cid:13)ह कर(cid:2)े में स्ቌम (cid:2)हीं है और पचित पर पूण(cid:13)रूप से आቦኌ8त है। परिरवा(cid:31) के उ्ሹ तथ््ों के सापे्ቌ निवप्ቌी (cid:2)े अप(cid:2)े उ्ቈरप्ቔ (11 ब) के ्ቚस्तर 2 में तथ्् ्ቚकट निक्ा है निक परिरवानि(cid:31)्ा संख््ा-1 पढ़ी लि,खी है। निवप्ቌी व उसके परिरवार वा,ो (cid:2)े परिरवानि(cid:31)्ा संख््ा-1 को बी०टी०सी० की ቦኌश्ቌा करा्ी और परिरवानि(cid:31)्ा संख््ा-1 की (cid:2)ौकरी ቦኌश्ቌानिम्ቔ के रूप में ्ቚा्ቕनिमक निव्ቕा,् बारी सनिहज(cid:2), रत(cid:2)पुर, ज(cid:2)प(cid:31) सु,ता(cid:2)पुर में ,गा ्ቕा। कुछ नि(cid:31)(cid:2) बा(cid:31) परिरवानि(cid:31)्ा संख््ा-1 की नि(cid:2)्ुनि्ሹ स््ቕाई रूप से ्ቚा्ቕनिमक निव्ቕा,् ताजु्ቌी(cid:2)पुर, सु,ता(cid:2)पुर में हुई। वहाँ परिरवानि(cid:31)्ा संख््ा-1 का वेत(cid:2) 50 हजार रूप्ा से अचिधक ्ቕा और वह सरकारी अध््ानिपका के रूप में कई वषI तक का्(cid:13)रत रही है। निवप्ቌी के उ्ቈरप्ቔ (11 ब ) के उ्ሹ तथ््ों से ऐसा ्ቚतीत होता है निक परिरवानि(cid:31)्ा संख््ा -1 ቦኌशचि्ቌका के तौर पर कई वषI तक का्(cid:13)रत रही है। निकन्तु निवप्ቌी के उ्ቈरप्ቔ में ्ह तथ्् स्प्ቖ (cid:2)ही होता है निक परिरवा(cid:31) ्ोजिजत हो(cid:2)े के नि(cid:31)(cid:2)ांक को भी परिरवानि(cid:31)्ा संख््ा -1 ቦኌशचि्ቌका 1) संज् कुमार (cid:2)े अप(cid:2)े -1 के तौर पर का्(cid:13)रत है। सम्भवता इसी कारण निवप्ቌी ( डी०डब्,ू० साቌኚ् शप्ቕप्ቔ (17 अ ) के ्ቚस्तर 10 में सशप्ቕ क्ቕ(cid:2) निक्ा है निक परिरवानि(cid:31)्ा संख््ा एक हु(cid:2)रमं(cid:31) ቦኌशचि्ቌत मनिह,ा है जो अप(cid:2)े मा्के में ्ूश(cid:2) कोिሜ(cid:24)ग (cid:24),ाकर अच्छे तरीके से - पोषण कर रही है। साቌኚ् शप्ቕप्ቔ आ् अቌኌजत कर रही है और अप(cid:2)ा व ब्ሴों को भरण (17 अ ) के उ्ሹ सशप्ቕ क्ቕ(cid:2)ों से ्ह स्प्ቖ है निक अ्ቕत(cid:2) रूप से परिरवानि(cid:31)्ा संख््ा -1 ቦኌशचि्ቌका के तौर पर का्(cid:13)रत (cid:2)हीं है। इस संबंध में निवप्ቌी ( डी०डब्,ू० 1) संज् से की गई ्ቚचितपरी्ቌा में ्ह स्वीकार निक्ा है निक ्ह कह(cid:2)ा सही है निक शकुन्त,ा वष(cid:13) (cid:2)ौकरी (cid:2)हीं कर रही है। इस ्ቚकार निवप्ቌी साቌኚ् शप्ቕप्ቔ (17 अ ) के ्ቚस्तर से कोई 1) संज् कुमार के मुख्् परी्ቌा 10 एवं ्ቚचितपरी्ቌा के उ्ሹ क्ቕ(cid:2) से ्ह एक(cid:31)म स्प्ቖ है ( डी०डब्,ू० 2016 निक परिरवानि(cid:31)्ा संख््ा -1 वष(cid:13) 2016 से त्ቕाकቦኌ्ቕत ቦኌशचि्ቌका की (cid:2)ौकरी (cid:2)हीं कर रही है। इसके बावजू(cid:31) निवप्ቌी ्ቛारा ्ቝामक तरीके से अप(cid:2)े जवाब(cid:31)ावें एवं साቌኚ् शप्ቕप्ቔ में इस ्ቚकार व(cid:24)(cid:2) निक्ें है निक जिजससे ऐसा दृश््मा(cid:2) हो निक परिरवानि(cid:31)्ा संख््ा-1 अ्ቕत(cid:2) रूप से ቦኌशचि्ቌका की (cid:2)ौकरी कर रही है। ऐसे छ्ቔ अቦኌभव(cid:24)(cid:2) निवप्ቌी की परिरवानि(cid:31)्ा संख््ा -1 को जा(cid:2)बूझकर भरण - पोषण कर(cid:2)े से उपे्ቌा कर(cid:2)े के तथ्् को अवधारिरत कर(cid:2)े को बाध्् भी करती है। निवप्ቌी ्ቛारा साቌኚ् शप्ቕप्ቔ (17 अ) के ्ቚस्तर 10 में परिरवानि(cid:31)्ा संख््ा-1 ्ቛारा मा्के में ्ूश(cid:2) कोिሜ(cid:24)ग (cid:24),ाकर अप(cid:2)ा व अप(cid:2)े ब्ሴों का भरण-पोषण कर(cid:2)े का क्ቕा(cid:2)क 3 ्ቚ्ቕम बार शप्ቕप्ቔ (17 अ) में ्ቚकट निक्ा है। ्नि(cid:31) उ्ሹ तथ्् में सत््ता रहती तो परिरवानि(cid:31)्ा संख््ा - 1 ्ቛारा मा्के में ्ूश(cid:2) पढ़ा(cid:2)े का तथ्् उ्ቈरप्ቔ (11 ब) के अवसर पर भी उ्ቈरप्ቔ में समावेश होकर आ जा(cid:2)ा (cid:24)ानिहए ्ቕा। ऐसे में शप्ቕप्ቔ (17 अ) में ्ቚ्ቕम बार परिरवानि(cid:31)्ा संख््ा-1 का मा्के में ्ूश(cid:2) कोिሜ(cid:24)ग (cid:24),ाकर अच्छे तरीके से आ् अቌኌजत 10 कर(cid:2)े का तथ्् मा(cid:2)े जा(cid:2)े ्ोग्् (cid:2)ही है। निवप्ቌी ्ቛारा साቌኚ् शप्ቕप्ቔ -1 ्ቛारा ्ूश(cid:2) कोिሜ(cid:24)ग (cid:24),ाकर आ् अቌኌजत कर(cid:2)े के संबंध में कोई ठोस आकडे आ् के संबंध में अंनिकत (cid:2)हीं निक्े है और (cid:2) ही अन्् कोई साቌኚ् ्ቚस्तुत की -1 के मा्के में ्ूश(cid:2) कोिሜ(cid:24)ग - (cid:24),ाकर अच्छे तरीके से आ् अቌኌजत कर अप(cid:2)ा व अप(cid:2)े ब्ሴों को अच्छे तरीके से भरण है निक जिजससे ्ह मा(cid:2)ा जा सके निक परिरवानि(cid:31)्ा संख््ा (17 अ ) के ्ቚस्तर में परिरवानि(cid:31)्ा संख््ा पोषण कर रही हो। एतद् परिरवानि(cid:31)्ा संख््ा -1 वष(cid:13) 2016 से त्ቕाकቦኌ्ቕत ቦኌशचि्ቌका / ቦኌश्ቌानिम्ቔ की (cid:2)ौकरी (cid:24),े जा(cid:2)े के कारण अप(cid:2)े परिरवा(cid:31)प्ቔ के ्ቚस्तर 10 एवं ्ቚस्तर 12 के अ(cid:2)ुरूप नि(cid:31)(cid:2)ांक -20.05.2016 से अप(cid:2)े माता - निपता के घर अप(cid:2)े (cid:31)ो(cid:2)ों (cid:2)ाबालि,ग ब्ሴों के सा्ቕ आभाव में जीव(cid:2) जी रही है त्ቕा परिरवानि(cid:31)्ा संख््ा -1 अप(cid:2)े त्ቕा अप(cid:2)े (cid:2)ाबालि,ग ब्ሴों को जीव(cid:2) नि(cid:2)वा(cid:13)ह कर(cid:2)े में स्ቌम (cid:2)हीं है और निवप्ቌी पर पूण(cid:13)रूप से आቦኌ8त है। इससे स्प्ቖ है निक परिरवानि(cid:31)्ा संख््ा-1 की कोई व््नि्ሹगत आम(cid:31)(cid:2)ी भरण-पोषण हेतु मौजू(cid:31) (cid:2)ही है जिजससे निक वह अप(cid:2)ा व अप(cid:2)ी पु्ቔी परिरवानि(cid:31)्ा संख््ा-2 त्ቕा पु्ቔ परिरवानि(cid:31)्ा संख््ा-3 का ््ቕोचि(cid:24)त भरण-पोषण कर सके और परिरवानि(cid:31)्ा संख््ा-1 अप(cid:2)े मा्के में अप(cid:2)े ब्ሴों सनिहत रहकर निकसी तरह गुजर बसर कर रही है। ऐसे में न््ा्ा,् का समाधा(cid:2) हो जाता है निक परिरवानि(cid:31)्ागण अप(cid:2)ा भरण-पोषण कर(cid:2)े में असम्ቕ(cid:13) है? त(cid:31)(cid:2)ुसार ्ह अवधा्(cid:13) ्ቚ् संख््ा-1 परिरवानि(cid:31)्ागण के प्ቌ में नि(cid:2)ቓኌणत निक्ा जाता है।"
10. On the aforesaid aspect of the case, this Court also took note of annexures annexed to the present revision.
11. Upon due consideration of the aforesaid, this Court finds that at the time of filing of the claim, i.e. the Maintenance Petition No. 50 of 2022, the opposite party No.2 was not working. In other words, she was not an earning lady and the revisionist tried to mislead the Family Court as also this court on the aforesaid aspect of the case. For the aforesaid reasons, this Court finds that in the instant

पोषण कर रही है। साቌኚ् शप्ቕप्ቔ आ् अቌኌजत कर रही है और अप(cid:2)ा व ब्ሴों को भरण (17 अ ) के उ्ሹ सशप्ቕ क्ቕ(cid:2)ों से ्ह स्प्ቖ है निक अ्ቕत(cid:2) रूप से परिरवानि(cid:31)्ा संख््ा -1 ቦኌशचि्ቌका के तौर पर का्(cid:13)रत (cid:2)हीं है। इस संबंध में निवप्ቌी ( डी०डब्,ू० 1) संज् से की गई ्ቚचितपरी्ቌा में ्ह स्वीकार निक्ा है निक ्ह कह(cid:2)ा सही है निक शकुन्त,ा वष(cid:13) (cid:2)ौकरी (cid:2)हीं कर रही है। इस ्ቚकार निवप्ቌी साቌኚ् शप्ቕप्ቔ (17 अ ) के ्ቚस्तर से कोई 1) संज् कुमार के मुख्् परी्ቌा 10 एवं ्ቚचितपरी्ቌा के उ्ሹ क्ቕ(cid:2) से ्ह एक(cid:31)म स्प्ቖ है ( डी०डब्,ू० 2016 निक परिरवानि(cid:31)्ा संख््ा -1 वष(cid:13) 2016 से त्ቕाकቦኌ्ቕत ቦኌशचि्ቌका की (cid:2)ौकरी (cid:2)हीं कर रही है। इसके बावजू(cid:31) निवप्ቌी ्ቛारा ्ቝामक तरीके से अप(cid:2)े जवाब(cid:31)ावें एवं साቌኚ् शप्ቕप्ቔ में इस ्ቚकार व(cid:24)(cid:2) निक्ें है निक जिजससे ऐसा दृश््मा(cid:2) हो निक परिरवानि(cid:31)्ा संख््ा-1 अ्ቕत(cid:2) रूप से ቦኌशचि्ቌका की (cid:2)ौकरी कर रही है। ऐसे छ्ቔ अቦኌभव(cid:24)(cid:2) निवप्ቌी की परिरवानि(cid:31)्ा संख््ा -1 को जा(cid:2)बूझकर भरण - 1 ्ቛारा मा्के में ्ूश(cid:2) पढ़ा(cid:2)े का तथ्् उ्ቈरप्ቔ (11 ब) के अवसर पर भी उ्ቈरप्ቔ में समावेश होकर आ जा(cid:2)ा (cid:24)ानिहए ्ቕा। ऐसे में शप्ቕप्ቔ (17 अ) में ्ቚ्ቕम बार परिरवानि(cid:31)्ा संख््ा-1 का मा्के में ्ूश(cid:2) कोिሜ(cid:24)ग (cid:24),ाकर अच्छे तरीके से आ् अቌኌजत 10 कर(cid:2)े का तथ्् मा(cid:2)े जा(cid:2)े ्ोग्् (cid:2)ही है। निवप्ቌी ्ቛारा साቌኚ् शप्ቕप्ቔ -1 ्ቛारा ्ूश(cid:2) कोिሜ(cid:24)ग (cid:24),ाकर आ् अቌኌजत कर(cid:2)े के संबंध में कोई ठोस आकडे आ् के संबंध में अंनिकत (cid:2)हीं निक्े है और (cid:2) ही अन्् कोई साቌኚ् ्ቚस्तुत की -1 के मा्के में ्ूश(cid:2) कोिሜ(cid:24)ग - (cid:24),ाकर अच्छे तरीके से आ् अቌኌजत कर अप(cid:2)ा व अप(cid:2)े ब्ሴों को अच्छे तरीके से भरण है निक जिजससे ्ह मा(cid:2)ा जा सके निक परिरवानि(cid:31)्ा संख््ा (17 अ ) के ्ቚस्तर में परिरवानि(cid:31)्ा संख््ा पोषण कर रही हो। एतद् परिरवानि(cid:31)्ा संख््ा -1 वष(cid:13) 2016 से त्ቕाकቦኌ्ቕत ቦኌशचि्ቌका / ቦኌश्ቌानिम्ቔ की (cid:2)ौकरी (cid:24),े जा(cid:2)े के कारण अप(cid:2)े परिरवा(cid:31)प्ቔ के ्ቚस्तर 10 एवं ्ቚस्तर 12 के अ(cid:2)ुरूप नि(cid:31)(cid:2)ांक -20.05.2016 से अप(cid:2)े माता - निपता के घर अप(cid:2)े (cid:31)ो(cid:2)ों (cid:2)ाबालि,ग ब्ሴों के सा्ቕ आभाव में जीव(cid:2) जी रही है त्ቕा परिरवानि(cid:31)्ा संख््ा -1 अप(cid:2)े त्ቕा अप(cid:2)े (cid:2)ाबालि,ग ब्ሴों को जीव(cid:2) नि(cid:2)वा(cid:13)ह कर(cid:2)े में स्ቌम (cid:2)हीं है और निवप्ቌी पर पूण(cid:13)रूप से आቦኌ8त है। इससे स्प्ቖ है निक परिरवानि(cid:31)्ा संख््ा-1 की कोई व््नि्ሹगत आम(cid:31)(cid:2)ी भरण-पोषण हेतु मौजू(cid:31) (cid:2)ही है जिजससे निक वह अप(cid:2)ा व अप(cid:2)ी पु्ቔी परिरवानि(cid:31)्ा संख््ा-2 त्ቕा पु्ቔ परिरवानि(cid:31)्ा संख््ा-3 का ््ቕोचि(cid:24)त भरण-पोषण कर सके और परिरवानि(cid:31)्ा संख््ा-1 अप(cid:2)े मा्के में अप(cid:2)े ब्ሴों सनिहत रहकर निकसी तरह गुजर बसर कर रही है। ऐसे में न््ा्ा,् का समाधा(cid:2) हो जाता है निक परिरवानि(cid:31)्ागण अप(cid:2)ा भरण-पोषण कर(cid:2)े में असम्ቕ(cid:13) है? त(cid:31)(cid:2)ुसार ्ह अवधा्(cid:13) ्ቚ् संख््ा-1 परिरवानि(cid:31)्ागण के प्ቌ में नि(cid:2)ቓኌणत निक्ा जाता है।"
10. On the aforesaid aspect of the case, this Court also took note of annexures annexed to the present revision.
11. Upon due consideration of the aforesaid, this Court finds that at the time of filing of the claim, i.e. the Maintenance Petition No. 50 of 2022, the opposite party No.2 was not working. In other words, she was not an earning lady and the revisionist tried to mislead the Family Court as also this court on the aforesaid aspect of the case. For the aforesaid reasons, this Court finds that in the instant
