Case Details
“(i) To issue a writ order or direction in the nature of CERTIORERI for quashing of the impugned decision dated 04.4.2025 taken by O.P. No. 3 for not extending the contract of petitioner after 31.3.2025, as contained in Annexure No. 1 of the writ petition. (ii) to issue a writ order or direction in the nature of CERTIORERI for quashing of the impugned approval of O.P. No. 1, as disclosed in impugned decision dated 04.4.2025, thereby summoning it in original from opposite party. (iii) to issue a writ order or direction in the nature of MANDAMUS to O.P. No. 3 thereby commanding and directing him to reinstate the petitioner in service keeping in mind the enquiry report dated 03.5.2025 vide Annexure No. 9 of the writ petition.” Facts, in brief, of the case are to the effect that petitioner, who is PLHIV person, was engaged on contract basis on the post of ‘Counsellor’ in terms of Government Order dated 03.03.2016. 2 It is not in dispute that in the case of petitioner, provisions of the Human Immunodeficiency Virus and Acquired Immune Deficiency Syndrome (Prevention and Control) Act, 2017 (in short “Act of 2017”) would be applicable. Relevant provision of the Act of 2017 is extracted here-in-under:- “PROHIBITION OF CERTAIN ACTS
3. No person shall discriminate against the protected person on any ground including any of the following, namely:- (a) the denial of, or termination from, employment or occupation, unless, in the case of termination, the person, who is otherwise qualified, is furnished with- (i) a copy of the written assessment of a qualified and independent healthcare provider competent to do so that such protected person poses a significant risk of transmission of HIV to other person in the workplace, or is unfit to perform the duties of the job; and (ii) a copy of a written statement by the employer stating the nature and extent of administrative or financial hardship for not providing him reasonable accommodation; (b) the unfair treatment in, or in relation to, employment or occupation; (c) the denial or discontinuation of, or, unfair treatment in, healthcare services; (d) the denial or discontinuation of, or unfair treatment in, educational, establishments and services thereof; (e) the denial or discontinuation of, or unfair treatment with regard to, access to, or provision or enjoyment or use of any goods, accommodation, service, facility, benefit, privilege or opportunity dedicated to the use of the general public or customarily available to the public, whether or not for a fee, including shops, public restaurants, hotels and places of public entertainment or the use of wells, tanks, bathing ghats, roads, burial grounds or funeral ceremonies and places of public resort; (f) the denial, or, discontinuation of, or unfair treatment with regard to, the right of movement; (g) the denial or discontinuation of, or, unfair treatment with regard to, the right to reside, purchase, rent, or otherwise occupy, any property; (h) the denial or discontinuation of, or, unfair treatment in, the opportunity to stand for, or, hold public or private office; 3 (i) the denial of access to, removal from, or unfair treatment in, Government or private establishment in whose care or custody a person may be; (j) the denial of, or unfair treatment in, the provision of insurance unless supported by actuarial studies; (k) the isolation or segregation of a protected person; (1) HIV testing as a pre-requisite for obtaining employment, or accessing healthcare services or education or, for the continuation of the same or, for accessing or using any other service or facility: Provided that, in case of failure to furnish the written assessment under sub-clause (i) of clause (a), it shall be presumed that there is no significant-risk and that the person is fit to perform the duties of the job, as the case may be, and in case of the failure to furnish the written statement under sub- clause (ii) of that clause, it shall be presumed that there is no such undue administrative or financial hardship.” It would be apt to indicate that a Committee consisting of three Members headed by C.M.O., Unnao was constituted on the issue of termination of service contract of the petitioner and according to the report of the Committee, termination of service contract of the petitioner is not proper. The report of the said Committee annexed as Annexure No.9 is extracted here-in-under:- “ मा० उप मुख्य मं्ቔी ्ቦी केशव ्ቚसाद मौय(cid:22) जी के प्ቔ दिदनांक-09.04.2025 के ्ቅम में मा० उप मुख्य मं्ቔी एवं चि(cid:30)किकत्सा शिश्ቌा मं्ቔी जी के काया(cid:22)लय प्ቔ सं० - 451/वी०आई०पी०/उ०मु०म०(पी)/2025, दिदनांक-22.04.2025 पर महानिनदेशक, चि(cid:30)किकत्सा एवं स्वास्थ्य सेवायें उ०्ቚ० महोदय के द्वारा किकये गये पृष्ठांकन के अनु्ቅम में आपके प्ቔांक संख्या ए०डी०/कैम्प-जां(cid:30)/2025/996-6 दिदनांक 24-04-2025 के गदिठत ቔኌ्ቔसदस्यीय जां(cid:30) कमेटी का गठन किकया गया, जिजसके सदस्य निनम्नवत है- 1) मुख्य चि(cid:30)किकत्सा अचि:कारी उन्नाव 2) सदस्य डा० उमेश स(cid:30)ान (अ:ीन अपर निनदेशक लखनऊ) 3) सदस्य ्ቦी अनूप कुमार (अ:ीन अपर निनदेशक लखनऊ) ्ቚश्नगत ्ቚकरण में मुख्य रूप से ्ቚासंचिगक ቔኌBन्दु निनम्नवत है- 1) यह किक ्ቦीमती शशिशकिकरन जिजला चि(cid:30)किकत्सालय उन्नाव में ए०आर०टी० केन््ቖ पर परामश(cid:22)दा्ቔी के पद विवगत 31 मा(cid:30)(cid:22) 2025 तक पर काय(cid:22)रत थी। 2) यह किक उसी केन््ቖ पर तैनात डा० अंकुर और डा० वि्ቚयंका का व्यवहार ्ቦीमती शशिशकिकरन के ्ቚनित असहयोगात्मक रहता था। 4 3) यह किक ्ቦीमती शशिशकिकरन ए(cid:30)०आई०वी० सं्ቅमण से ्ቇशिसत है और इस Bात का उपरोक्तगण दुष््ቚ(cid:30)ार करते रहते हैं। 4) यह किक ्ቦीमती शशिशकिकरन की उपरोक्तगण ने अ:ी्ቌक जिजला चि(cid:30)किकत्सालय, उन्नाव डा० रिरयाज शिमजा(cid:22) द्वारा अनुचि(cid:30)त रूप से संविवदा समाप्त करवा दी है। अपर निनदेशक महोदय द्वारा गदिठत उपरोक्त कमेटी के सदस्यगणों द्वारा ्ቚाचिथ(cid:22)नी ्ቦीमती शशिशकिकरन एवं आरोविपतों डा० अंकुर एवं डा० वि्ቚयंका एवं अ:ी्ቌक जिजला चि(cid:30)किकत्सालय, उन्नाव के Bयान लेने एवं उपलब्द कराए गए सभी ्ቚप्ቔों के अवलोकनोपरान्त (सभी उल्लेखिखत ्ቚप्ቔ संलग्न हैं) एकमत से निनष्कविV(cid:22)त हुआ किक- 1) यह किक ्ቦीमती शशिशकिकरन द्वारा लगाए गए उपरोक्त आरोपों में से ्ቅम संख्या 2 एवं 3 की पुजिष्ट हेतु ्ቦमती शशिशकिकरन द्वारा कोई भी ्ቚमाखिणक साቌኚय ्ቚस्तुत न किकया जा सका। 2) यह किक ्ቦीमती शशिशकिकरन की संविवदा समाप्त करने से पूव(cid:22) उसे निनयमानुसार मौखिखक (cid:30)ेतावनिनयां एवं तदोपरान्त समुचि(cid:30)त Bार नोदिटस के पश्(cid:30)ात् ही संविवदा समाजिप्त की ्ቚकि्ቅया आरम्भ किकया जाना अपेቌኌ्ቌत था, जो किक उपलब्: अशिभलेखों से ्ቚमाखिणत नहीं होती है। निनष्कV(cid:22) उपरोक्त तथ्यों के आलोक में सशिमनित एकमत से इस निनष्कV(cid:22) पर पहुं(cid:30)ी है किक ्ቦीमती शशिशकिकरन की संविवदा समाजिप्त हेतु समुचि(cid:30)त कारण दृजिष्टगत नहीं हुए। अतः संविवदा समाजिप्त का आदेश निनरस्त करने की संस्तुनित की जाती है। आपकी सेवा में यह जां(cid:30) आख्या ्ቚस्तुत है।” Taking note of aforesaid, this Court finds that the impugned order decision/dated 04.04.2025 passed by the respondent No.3-Joint Director CST, U.P. State AIDS Control Society, Lucknow is unsustainable in the eye of law. Accordingly, the writ petition is allowed. The order dated 04.04.2025 is hereby quashed. The respondent No.3 shall pass a fresh order after taking note of the report of the Committee dated 03.05.2025 and the statutory provisions, quoted above.
