Judgment
Heard Shri Dhirendra Kumar Mishra, learned counsel appearing for the applicants and learned Additional Government Advocate appearing for the State.
The instant application under Section 482 Cr.P.C./528 B.N.S.S., 2023 has been filed challenging therein, the order dated 01.05.2025, passed in Sessions Trial No.1086 of 2021 (State Vs. Krishna Kumar and Ors.), whereby the learned trial court had permitted the applicants to cross-examine P.W.-5 on payment of Rs.5,000/-
Learned counsel appearing for the applicants has raised limited prayer in this application that the amount imposed by the learned trial court is on a higher side and it may be reduced.
Learned Additional Government Advocate appearing for the State does not have any objection if, this Court reduces the amount imposed by the learned trial court in the impugned order.
I have considered the arguments of the learned counsel appearing for the applicant.
Since, the limited prayer has been raised in this application, this Court provides that the applicants would be required to pay only Rs.500/- under the impugned order dated 01.05.2025 and all the other directions issued in the order impugned, shall remain intact.
With the aforesaid direction, this application is finally disposed of. Order Date :- 5.6.2025 V. Sinha VAISHALI SINHA High Court of Judicature at Allahabad, Lucknow Bench
